APPROVED AS TO FOR M AND LEGALITY I NTRODU CED 8Y COU NCILMEMB ER y OR DI NANCE N o __ 12151 c M s A N OR DI NAN CE ADO PTI NG LOC AL AMEND MEN TS TO TH ALIFO RN IA BUI LD ING STANDARDS C E, CALIFO RN IA COD O F REGULATIONS (CCR), IT LE 24 , PART 9 ( ALIFO RN IA FIR COD E) A N D AMEND I NG T HE OAKLAND UN ICIPAL C DE C AP TER -15.12 Whereas, the Council of the City of O akland does h ere by find that premises exist within the City which are hazards of fire or explosion because there exist vacant a nd occupied buildings thereon an d als o conditions there on or therein, and such buildings a nd conditions ar e hazards to life o r property because o f failure to keep them in a rea sonable degree of repair; or lack of prope r storage facilities, or lack of disposal or improper disposal of vegetation or materials susceptible to uncontrolled combustion; or failure to reduce the amount of or provide adequate separation from a fue l load contributing to th e risk of a fire hazard; or improper handling and use of hazardous substances, mater ials, and devices; or overcrowding of the pr emis es by pu blic patrons; or physica l impair ment or improper maintenance of exits and paths of travel and me ans of emerge ncy access; or improper mainte nanc e of fire detection and warning devises and equipment and systems; or improper maintenance of fire suppre ssion equipm ent a nd systems; or any combination of these factors, which h a s resulted in such premises jeopardizing life or property in the use or occupancy of buildings or premises so a s to be detrimental to the health, safety, or general welfare and the comfortable enjoyment of living, or the people of the City; and Whereas, th e Council of the City of Oakland further hereby finds that hazardous premises and such hazardous buildings existing thereon and such ha zardous condition existing there on or therein a r e dangerous to the public health, safety, and the comfortable enjoyment o f living of the people; that conditions existing o n such prem ise s necess itate excessive and disproportionate expenditure of public funds for public safety, fire protection a nd other public services; a nd that t h e conditions on such ha zardous premises cause a dra in upon public revenue a nd impair the efficient and econo mical exer cise of governmental functions in s uch are as; and Whereas, th e Council of the City o f O akland further he reby finds that th e elimination of hazardous premises and of conditions dangerous or imminently hazardous to life or limb or health or safety of the public or other property and the prevention of the occurrence and recurre nce of haza rdous premises and of dangerous or imminently hazardous condit ions in the future is in the best interes ts of the citizens of O akland, the S tate of California, and the entire United S tates; and that the accompli shme nt of this end will be fostered and e ncouraged by the enactment and enforcement of this Ordinance; a nd
