Lease Hold System of Land Tenure

ln pursuance of orders issued by the Govt. of lndia, DelhiDevelopment Authority has decided to convert Flats/Floors/shops in

multistoried Residential and Commercial Complexes in Delhi frorn

lease hold to free hold on payment of conversion charges. Theprescribed conversion charges are applicable upto 31 .3.2011 which areprovisionalsubjectto approvalof the Ministryof UD, Govt. of lndia,

SALIENT FEATURES OFTHE SCHEME

1. The scheme covers all Flats/floors/shops in multistoriedResidentiai and Commercial Complexes where the lease has beengranted on behalf of the President of lndia/Delhi DevelopmentAuthority,

2. The onetime charges payable for conversion from leasehold tofreehold are set out in Annexure "AA" read with Annexure "B'.These charges are to be paid in lump-sum. Asurcharge of 33-1/3%on the conversion fee would be payable overand above the normalconversion charges.

3. lndividual flats/floorsishops in multi-storied residential, commercia!and mix land use complexes shall be considered for conversionfrom leasehold to freehold in cases where the owners have

complied with the following conditions.

a) Permission had been obtained from the lessor for constructionof multi-storied group housing complexes and multi storiedcommercialcomplexes;

b) The lessees have complied with the bye laws and regulationslaid down bythe Central, State &localbodies;

c) The building plans have been sanctioned by the by the localbody as multi-storied group housing complexeslmulti-storiedcommercialcomplexes;

d) The purchaser shall have to give clear proof of his ownership

- Application for conversion to be made by a person holdingpower of attorney from lessee/sub iessee/allottee to alienate(sell/kansfer) the property.

* Proof is given of possession of the property in favour of theperson in whose name conversion is being sought:

Where there are successive powerof attorneys, conversion willbe allowed after verifying the factum of physical possessionprovided that the linkage of original lessee/sub lessee allotteewith the last power of attorney is established and attesteci

copies of powerof attorneys are submitted;

Conversion of individual flats/floors/shops in such complexeswili be subject to the owner paying the Proportionate amount oftotal outstanding dues like group rent, misuse charges etc.in respect of the property as a whole plus the dues thatare attributable to the particular flaUshop being consideredforconversion.

4. The application for conversion shail not be entertained unlessaccompanied by prescribed documents.

5. The proportionate arrears of ground rent arong with interest @ 1 0%per annum wherever applicable would have to be paid by theapplicant before conversion can be permitted. ln case whererevision of ground rent has become due, the revised amount of rentwill be notified to the appricant for depositing the amount before theexecution ofthe conveyance deed.

6. The conversion shail be appricabre onry for the properties which areon land for which the rand use prescribed in the iease deed/sublease deed/alrotment letter is commerciar/Residentiar or mixed asthe case may be.

7 . ln cases of mortgaged properties conversion wourd be ailowed onryon submission of ,No

Objection Certificate(s), from all thernortgagees. lf the propefi has been mortgaged more than oncethen 'No 0bjection Certificates, from all ttie mortgagees arerequired to be submitted. rn case the appricant is unabri to producethe Noc from the mortgagees then an rndemnity Bond shari have tobe furnished to the effect that the property under reference is notmortgaged and if at any later stage it is found that the prope(y wasunderdispute orundermortgage, DDAshall cancel theconv.yrr..deed. Further, the applicant shall have to produce all originaldocuments viz allotment letterand possession ietter.

8. ln cases where lease deeds have not been signed, conversion willbe allowed provided that the non-execution oi the rease deed hasbeen on account of administrative reasons and not because ofcertain defaurts on the part of the ailottees. However, in such casesthe stamp duty would be payable on the amount of conversioncharges and the surcharge wherever applicable as well as theprice/premium of the property.

9. ln case of any legal dispute relating to tifle of the property,conversion shall be not be allowed until the legal dispute is settied.'

10 (ii) ln cases of re-entered properties conversion wourd be ailowedonly when re-entry notice has been withdrawn and thelease/sub rease/ailotment restored. The rates of conversioncharges prevalent at the time of withdrawal of re_entry noticeand restoration of the rease/sub rease/afiotment wiil beapplicable.

1 0 (iii) For the purpose of conversion, misuse charges wourd be reviedupto the date of application of conversion. However, even afterconversion, action against continuing misuse wourd continue tobe taken by the respective local bodies under the byelaws/regulations.

10 (iv)Conversion to freehold shall not be permitted in respect ofproperties involving encroachment on governmenUpublic land.

The lessee would have to vacate the encroached land before

consideration of the conversion application and the

applicant shall also be liable for payment of proportionate

occupation charges/damages for the unauthorized use and

occupation as per applicable rates.

10 (v) Conversion to freehold shall not be permitted in respect ofproperties involving amalgamation or sub-division.

11. ln case of any dispute between the original lessee/sub/ lessee/

alloftees and Power of Attomey holder, application for grant of

freehold rights would be entertained only afterthe dispute is settled.

1 2. I n cases where applications for mutation or substitution are pending

with the lessor, conversion would be allowed only after the

necessary mutationlsubstitution has been canied out.

13. The scheme conversion is optional.

14. The conversion formula has been given in Annexure A & 'M'. The

zone wise location wise rates are given in Annexure 'B'. The

Iocalities for which land rates have not been given in Annexure-B,

the rates of the adjoining/comparable locality would be applicable.

15. Model calculations of conversion charges and surcharge have

been given inAnnexure'C'.

16. The requisite conversion charges additional conversion charges

17. Model of remittance shall be preferably by pay order, bank draftpayable at Delhi. The amount of remittance has to be rounded off to

the nearest rupee. The payment is to be made through the

prescribed challan form which is a part of application and is inquadruplicate. After depositing the application form and the

conversion charges, applicants must ensure to obtain an

acknowledgment from the bank together with a copy of the

challan to serve as proof of payment fortheirfuture reference,

The conversion charges and surcharge wherever applicable are to

be deposited in lump sum.

lf there is only one allottee / sublessee / lessee of the propertysought to be converted into freehold, hls name and otherparticulars should be given in sub-column (a). lf there are twoallottees / sub-lessees / lessees, the names and other particularsshould be given separately in sub-column (a) & (b). lf there aremore than two lessees/sub-lessees/allottees, a separate sheetbe attached giving the required particulars.

lf the application is submitted by an attorney duly authorized toseek sale permission, execute the Sale Deed and get itregistered on behalf of the lessee/sub-lessee/allottee, hisparticulars should be given in this column. This column is applicable only in cases where conversion issought in favour of a person other than the ressee/sub-ressee,allottee and the apprication is submitted by the Attorney. rt wourd,however, be necessary that the person in whose favour theconversion is sought is in physical possession of the propertyunder a valid Agreement to Sell executed in his/her favour.

Golumn4

Under sub-column (ii), some authentic document viz. attestedPhotostat copy of Ration Card, passport, Driving Licence etc.should be submitted in proof of possession with the personnamed in column 3. Under sub-column (iii), attested true copy ofAgreement to seil or any other authentic document showing thatthe person named in column 3 has already agreed to purchasethe property is required to be submitted.

File number is given on the communications sent to thelesseelsublessee/allottee by the DDA and can be takenfrom there.
