OUR TOwNLocated at 78 degrees north, Longyearbyen is officially the world’s northernmost town and also one of its most fascinating. Just 1300km from the North Pole, Longyearbyen has become a vibrant, modern and international tax-free settlement. Located on Spits-bergen, in the Svalbard Archipelago, the town is a gateway to the wonders of the high Arctic region.

Summer in this area is a magical time, when the sun never sets and the cries of migratory birds fill the air. The Svalbard Archipelago is classified as an Arctic desert due to the low annual precipitation; however, the climate is relatively mild, thanks to the passage of the Gulf Stream along the west coast. Longyearbyen welcomes visitors to our slice of the Arctic, a safe haven in the otherwise harsh and wild landscape, where polar bears roam and the elements rule. Almost all of the colourful houses are built on poles to combat the permafrost, and the lion’s share of all produce is shipped or flown in. While tourists can safely walk around the town area, the polar bears on the archipelago outnumber the humans, meaning high calibre rifles and flare guns should be carried when entering the wilder-ness.

With our highly knowledgeable and well-trained guides, Spits-bergen Travel has been a vital force in the development of Long-yearbyen as a ‘Mecca’ for adventure. Be it hiking or Champagne tasting, a fjord safari in high-powered Polarcirkel boats or a guided visit to the award-winning Svalbard Museum, Spitsbergen Travel can ensure that your guests have the opportunity to experience all this unique town has to offer.

AbOUT SPITSbERgEN TRAVElSpitsbergen Travel is the largest and most experienced tour operator and agent in Longyearbyen, as well as the main shore-ex supplier, with the widest selection of activities available no matter the season. TOURS & ACTIVITIES SPECIFICATION | 19

1. VAliDity:These conditions apply to the extent that there is no other written agreement for arrangements booked between Spitsbergen Travel AS, hereafter the Operator, and the customer, hereafter the Customer.

2. pricing:Prices are stated in the quotation. Late arrival after the start of the planned arrangement or departure prior to the end of the arrangement does not provide an entitlement to a price reduction in the quotation unless otherwise previously agreed in writing. Any price increases due to changes to the agreement caused by the Customer are the sole responsibility of the Customer.

3. Booking:The contract in its entirety (meals, activities, transport, etc.) is binding for both parties once the Customer has signed the contract for the arrangement, and Spitsbergen Travel has reconfirmed in writing. When booking additional meals, activities, transport etc. after the original contract has been signed, all extra bookings must be confirmed in writing by both the Operator and the Customer, and these bookings shall be subject to the same conditions as in the original contract.

4. pAyment:Arrangements must be prepaid in full before the group’s arrival. On confirmation by Spitsbergen Travel, an invoice for the total price of the arrangement will be forwarded to the Customer. After the due date, late payments are subject to an interest charge of 1% per month and a monthly reminder fee of NOK 50. Nb! If the programme is changed by the Customer after arrival (for example, activi-ties or meals cancelled in favour of a different option), the original reservations must be paid for in full in addition to any new elements in the programme.

5. Allergies AnD speciAl neeDs:Information regarding any pertinent food allergies or special needs for individual group members must be received by Spitsbergen Travel at least 7 days prior to arrival.

6. unforseen eVentsIn the case of events outside of the Operator’s control (aviation strikes, delays, weather/road conditions, fire, missing deliveries, etc.) the Operator will not be not liable for compensation for additional costs and/or losses to the Customer. Should any events affect the programme, the Operator will where necessary shorten or adjust the timing to prevent any issues regarding the sailing time of the ship. Any monetary effect that this may be perceived to have upon the product will not be refunded by the Operator.

7. trAnsportAtionThe Operator and its suppliers have valid and appropriate insurance cover. The vehicles used by the Operator and its suppliers follow safety standards

as stated in the local regulations, and comply with all local public transport laws. None of the vehicles used by the Operator or its suppliers have toilet facilities. None of the vehicles used by the Operator or its suppliers are modified for easy access for individuals with limited mobility.

8. speciAl conDitions: Due to the special Arctic weather conditions, the Operator reserves the right to amend the agreed programme during the arrangement. However, the Operator, in collaboration with the Customer, will make every effort to find suitable alterna-tive solutions within the framework of the original package price. If parts of the arrangement cannot be carried out and alternative activities are not deemed satisfactory, the package price will be adjusted subject to agreement between the Operator and the Customer. The Operator is not financially liable for any extra costs incurred due to inclement weather conditions.

9. liABility for DAmAge:The Customer is liable for damage caused to the premises, equipment, meeting rooms, restaurants etc. as a result of the negligent or intentional conduct of the participants. All participants agree to follow the guide’s instructions when joining any tour. The Operator is not liable for damage to property or personal injury affecting the participants where such injury or damage is not due to circumstances the Operator should or could have avoided, or subjective circumstances related to each participant, including a lack of adherence to instructions or similar from the individual event organisers.

10. complAints:If the Customer believes that there is an issue or omission in the arrangement, this must be taken up with the Operator’s representative immediately. If the deficiency is not rectified and the Customer wishes to complain about the arrangement on returning home, a written statement of complaint must be submit-ted as soon as possible and no later than one month after the trip was completed. As this is not considered to be a package tour, Pakkereisenemnda (the package tour complaints body) will not be able to consider any complaint. If the parties are unable to agree on how to resolve a dispute based on the contract for the arrange-ment, voluntary arbitration will be accepted in accordance with the provisions of the Dispute Act. Each of the parties will then appoint an arbitrator no later than 3 weeks after the final rejection/acceptance of the claim/offer, and these two shall agree on an arbitration judge within the deadlines set by the parties.
