Applications for leave to remain under the Points Based System will fall for refusal if you have

overstayed for more than 28 days on the date of application, unless there were exceptional

circumstances which prevented you from applying within the 28 day period. The 28 day period of

overstaying is calculated from the latest of:

theendofthelastperiodofleavetoenterorremaingranted,

theendofanyextensionofleaveundersections3Cor3DoftheImmigrationAct

1971, or

thepointawrittennoticeofinvalidityisdeemedtohavebeenreceived,in

accordancewithparagraph34Cor34CAoftheImmigrationRules,inrelationtoan

in-time application for further leave to remain.

Ifthereareexceptionalcircumstanceswhichpreventedyoufromapplyingintimeyoumustsubmitevidenceoftheexceptionalcircumstanceswithyourapplication.Thethresholdforwhat

constitutes exceptional circumstances is high and will depend on the individual circumstances

ofthecase,butforexamplemayincludedelaysresultingfromunexpectedorunforeseeable

circumstances such as the following:

seriousillnesswhichmeantthatyouoryourrepresentativewereunabletosubmit

theapplicationintime(wheresupportedbyappropriatemedicaldocumentation).

travelorpostaldelayswhichmeantthatyouoryourrepresentativewereunableto

submittheapplicationintime.

inabilitytoprovidenecessarydocuments.Thiswouldonlyapplytoexceptionalor

unavoidablecircumstancesbeyondyourcontrol,suchasUKBorderAgencybeing

atfaultinthelossof,ordelayinreturning,traveldocuments,ordelayinobtaining

replacementdocumentsfollowinglossasaresultoftheft,reorood(where

supportedbyevidenceofthedateoflossandthedatereplacementdocumentswere

sought).

1. ThisdocumentprovidespolicyguidanceforfamilymembersofaPBSmigrant.Itreectspolicy

atthedateofpublicationandwemaychangeit.Itshouldbereadtogetherwithparagraphs319A

to319KoftheImmigrationRules.Forthepurposeoftheseguidancenotes,thetermswe,us

andourrefertotheUKBorderAgency.Whenwerefertoyouoryour,thismeansthePBS

dependant.

2. YoucanapplyasaPBSDependantifyoumeetthecriteriasetoutinthisguidanceandtheImmigrationRules,andyouare:

thefamilymemberofapersonwith,orapplyingfor,leaveunderTier1,2,4or5ofthe

Points Based System; or

thespouseorpartnerofapersonwithindeniteleavetoremainorBritishCitizenship

wholastheldleaveinTier1,2,or5ofthePointsBasedSystemandyoudonotyetqualifyfor

indeniteleavetoremain;or

thechildofapersonwithindeniteleavetoremainorBritishCitizenshipwholastheld

leaveinTier1,2,or5ofthePointsBasedSystemand:

o yourotherparentdoesnotyetqualifyforindeniteleavetoremain;and

o youlastheldleaveasPBSDependantgrantedonorafter9July2012.

3.WherewerefertothedependantofaTier1,2or5migrant,allofthesereferenceswillalso

include those applicants who are applying for further leave to remain in the PBS dependant

categorywhentheirsponsor(theTier1,2or5migrant)hasgoneontoacquireindeniteleaveto

remain.Ifyouareapplyingasthedependantofapersonwhohasindeniteleavetoremain,or

BritishCitizenship,youshouldreadthisguidanceasiftheywerestillintheirlastPBSimmigration

category.ForexampleifthepersonwithindeniteleavetoremainlastheldPBSleaveinTier1,

you should read the guidance as if you are applying as the dependant of a Tier 1 migrant.

4.AfamilymemberofaTier2andTier5PBSmigrantapplyingintheUnitedKingdomcanmake

theirPBS(Dependants)applicationonlineorusingtheequivalentpaperapplicationform.Family

membersofaTier1andTier4PBSmigrantapplyingintheUnitedKingdommustmaketheir

PBS(Dependants)applicationusingthepaperapplicationform.

6. You must ensure that you provide all of the necessary supporting documents at the timeyousendsusyourapplication.Wewillonlyacceptthesupportingdocumentsspeciedinthe

ImmigrationRules.

7. Ifyouhavesubmitted:

Asequenceofdocuments,andsomeofthedocumentsinthesequencehavebeenomitted(for

example,ifonebankstatementfromaseriesismissing);

Adocumentinthewrongformat;

Adocumentthatisacopyandnotanoriginaldocument.

wemaycontactyouoryourrepresentativeinwriting,andrequestthecorrectdocuments.Wemust

receivetherequesteddocumentsattheaddressspeciedintherequestwithin7workingdaysof

thedateoftherequest.Wewillnotaskforfurtherinformationwherewedonotanticipatethata

correction of minor errors or omissions will lead to an approval.

Ifyouhavesubmittedaspecieddocumentthatis:

inthewrongformat,or

acopyandnotanoriginaldocument,

wemayapproveyourapplicationexceptionallyifwearesatisedthatthespecieddocumentsare

genuineandthatyoumeetalltheotherrequirements.Wereservetherighttorequesttheoriginal

documentsinthecorrectformatandtorefuseapplicationsifthespecieddocumentsarenot

provided.

8. Anydocumentaryevidencethatyouprovidemustbetheoriginal(notacopy)unlesswesay

otherwise.

9. WhereadocumentisnotinEnglishorWelsh,theoriginalmustbeaccompaniedbyafully

certiedtranslationbyaprofessionaltranslator.Thistranslationmustincludedetailsofthe

translatorscredentialsandconrmationthatitisanaccuratetranslationoftheoriginaldocument.

Itmustalsobedatedandincludetheoriginalsignatureofthetranslator.

10.Weonlyneedevidencethatisdirectlyrelevanttotheapplication,assetoutintheImmigrationRulesandthisguidance.Wewillnotconsiderunrelatedevidence.

11. IfyouarethedependantofaTier4Studentswhoqualiesforourdifferentiationarrangements

becauseyouareconsideredtobelowrisk,youwillberequiredtoprovidefewerevidential

documentswhensubmittingyourapplication.Whereyouareexemptedfromhavingtoprovide

adocument-oragroupofdocuments-underourdifferentiationarrangements,thiswillbe

specicallystatedinthisguidance.TheUKBorderAgencyreservestherighttorequestthese

documents from you in all cases.

12. Youqualifyforourdifferentiationarrangementsif:

TheTier4studentissponsoredbyaHighlyTrustedSponsor;and

YouareapplyingforleaveatthesametimeastheTier4student;and

Youareapplyingforentryclearanceinyourcountryofnationalityorforleavetoremain

intheUK;and

YouholdthesamenationalityastheTier4studentandbothofyouarenationalsofone

of the following countries:

Argentina

Australia

Botswana

Brunei

Canada

Chile

Croatia

HongKong

Japan




Malaysia

New Zealand

Singapore

SouthKorea

Taiwan

TrinidadandTobago

UnitedStatesofAmericaoryouare

a British National Overseas

Verication and other checks

13.Weaimtoconsiderapplicationsquickly.However,wemustalsobecondentthatapplications

meettherequirementsoftheImmigrationRules,andthattheinformationyouprovideisatrue

reectionofyourbackground.

14.Wewillaskforavarietyofveriabledocumentstoenableustoconsideryourapplication.

15.Wemaywanttocheckthesupportingdocumentsyousendwithyourapplication.Therefore,

youmustensurethatalltheevidencecomesfromasourcethatcanbeclearlyidentiedandthat

itcanbeindependentlyconrmedasbeinggenuine.

16. Therearetwosituationsinwhichwewillundertakeacheck:

Verication checkswherewehavereasonabledoubtsthatthedocumentsare

genuine; or

ohr hkswherewecarryoutfurtherchecks,forexample,wherewehavedoubts

aboutanapplication,orthedocumentssentwiththeapplication,butthedoubtsarenotserious

enoughforustomakeavericationcheck.

Verication checks

17. Wherewehavereasonabledoubtsthataspecieddocumentisgenuinewemaywanttoverify

the document with an independent person or government agency.

18. Thepurposeofthesechecksistoensurethatthedocumentprovidedisgenuineand

accuratelyreectsstatementsmadeinyourapplication.Ifthedocumentisbeingusedas

evidencetosupportyourapplication,wealsowanttoensurethatitmeetstherequirementsofthe

Rules.

19. Vericationmaydelayourdecisiononyourapplicationsowewillonlydoitwhenthereare

clear reasons for it.

20.Therearemanyreasonswhywemaydoubtthataspecieddocumentisgenuineandwhat

weconsidertobeareasonabledoubtwilldependonanindividualapplication.However,our

judgmentswillbebasedonthefactswehave.




Outcome of verication check

21. Therearethreepossibleoutcomesofavericationcheck:

Document conrmed as genuine.Ifwecanconcludethatthedocumentisgenuine,

we will consider your application as normal.

Document conrmed as false.Ifwecanconcludethatthedocumentisfalse,wewill

refusetheapplication,whetherornotthedocumentisessentialtotheapplication.Ifadocumentis

conrmedasfalsewewillnormallyrefusetheapplicationformorethanonereason.Forexample,ifyousendusabankstatementtoshowthatyouhaveenoughfundsavailable,andwehave

evidencethatthestatementisfalse,wewillrefuseyourapplicationbecauseyoudonotmeetthe

fundsrequirementandbecauseyouhavesentafalsedocument.

Verication check inconclusive.Ifwecannotverifythatthedocumentiseither

genuineorfalsethenwewillignoreitasevidence.Ifyouhavesentotherspecieddocumentsas

evidencethatyoumeettherequirementsoftheRules,wewillconsidertheseasnormal.Ifyou

havenotsentanyotherdocuments,youwillnotmeettherequirementsoftheRules.

Refusing applications without making verication checks

22. Wemayrefuseanapplicationwithoutmakingvericationchecksintwocircumstances:

Whereweareconcernedaboutapieceofevidencebutwouldinanyeventrefusethe

applicationforotherreasons,thosereasonswillformthebasisoftherefusal.Wewillnotmake

vericationchecksinthesecircumstances.However,wewillalwaysverifypassportsifwedoubt

they are genuine.

Wherethereisevidencethatprovesaparticulardocumentisfalse.Ifwecanconrm

thatadocumentisfalsewewillnormallyrefusetheapplicationformorethanonereason.For

example,ifyousendusabankstatementtoshowthatyouhaveenoughfundsavailable,andwehaveevidencethatthestatementisfalse,wewillrefusetheapplicationbecauseyoudonotmeet

thefundsrequirementandbecauseyouhavesentafalsedocument.

23.Wewillmakeothercheckswhere,forexamplewehavedoubtsaboutanapplication,or

thedocumentssentwiththeapplication,butthesearenotseriousenoughforustomakea

vericationcheck.

24.Thesechecksmaydelayourdecisiononanapplicationsowewillonlymakethemwhenwehave clear reasons to do so.

25.Sometimeswewillhavesuspicionsaboutadocument,buttheywillnotbeenoughtomake

usdoubtthatitisgenuine.Forexample,thismaybebecausepreviousvericationcheckshave

found that some supporting evidence is invalid and some is genuine, or where evidence provided

contradictsinformationwealreadyhave.Inthesecases,wemaycarryoutmorechecks.

26. Therearefourpossibleoutcomesofthesechecks:

Document conrmed as genuine.Ifwecanconcludethatthedocumentisgenuine,

we will consider the application as normal.




Document conrmed as false.Ifwecanconcludethatthedocumentisfalse,wewill

refusetheapplication,whetherornotthedocumentisessentialtotheapplication.Ifadocumentis

conrmedasfalsewewillnormallyrefusetheapplicationformorethanonereason.Forexample,

ifyousendusabankstatementtoshowthatyouhaveenoughfundsavailable,andwehave

evidencethatthestatementisfalse,wewillrefuseyourapplicationbecauseyoudonotmeetthe

fundsrequirementandbecauseyouhavesentafalsedocument.

Procedure for verication and other checks

27. Theproceduresforbothvericationchecksandothercheckswillusuallybesimilarandwill

varyfromcasetocase,buttheymayinvolve:

checkingthedetailsorgenuinenessofdocumentswithemployers,therelevantembassyorhighcommission,othergovernmentdepartments(intheUnitedKingdomandoverseas);and

checkingtheaccuracyandauthenticityofdocumentswithbanks,universitiesand

professionalbodies.

29. YoushouldreadtheImmigrationRulesthatapplyatthetimethatyoumakeyourapplication.

30.WewillgrantleaveinlinewiththeexpirydateofthePBSmigrants(ormainapplicants)leave,

exceptwherethePBSmigranthasbeengrantedindeniteleavetoremain.Inthesecases,we

willgrantyouaperiodofthreeyearsleave.Anapplicationforfurtherleavemaythenbemadeif

requiredtotakeyouuptotheapplicablequalifyingperiodforindeniteleavetoremain.

31.IfyouarethefamilymemberofaTier1,2,or5migrant,switchingispermittedwhenapplying

as:

afamilymemberwhohasorlasthadentryclearanceorleavetoremainasthepartner

orchildofapersonwhohadleaveunderanothercategoryandwhohassincebeengranted,oris,

atthesametime,beinggrantedleavetoremainasarelevantPointsBasedSystemmigrant;or

achildbornintheUKtoaPBSmigrantandtheirdependantpartner

32.IfyouarethefamilymemberofaTier4(General)applicant,whetherornotyouarepermitted

toswitchintothePBSDependantcategory,dependsonthetypeofpermissiontostaythatyou

haveandtypeofcoursetheTier4(General)studentisorwillbestudying.

33.Switching is permitted when you have previously held leave as:

thedependantoftheleadapplicantinanotherimmigrationcategoryandthelead

applicanthassincebeengrantedleaveasaTier4(General)migrantorisapplyingforleaveatthe

same time as the lead applicant; or

achildbornintheUKtoaPBSmigrantandtheirdependantpartner.Achildborninthe

UKtoaPBSMigrantandtheirdependantpartnermusteither:

havebeenbornduringthePBSMigrantsmostrecentperiodofleaveasaTier

4(General)StudentorStudentandtheircoursemusthavebeenformorethansix

months duration; or

wherethePBSMigrantsmostrecentperiodofleavewastore-sitexaminationsor

repeatamoduleofacourse,thechildmusthavebeenbornduringaperiodofleave

granted for the purposes of re-sitting examinations or repeating a module of a course

orduringtheRelevantPBSMigrantsgrantofleaveforacourseofmorethansix

months, where that course is the same as the one for which the most recent grant of

leave was to re-sit examinations or repeat a module; or

musthavebeenbornnomorethanthreemonthsaftertheexpiryofthatmost

recentgrantofleaveandmustbeapplyingforentryclearance.

The main applicant must also:

beaGovernmentsponsoredstudentwhohasorisapplyingforleaveforacourseof

study that is longer than 6 months; or

bestudyingacourseofstudythatis12monthsormoreatarecognisedbodyoraUK

HEIwhichisatpost-graduatelevel;or

haveorhavelasthadleaveasaTier4(General)migrantorasaStudentforacourseof

study that more than 6 months long, and:




havehadthisleavewithinthe3monthsimmediatelyprecedingthedateofthe

application,

beapplyingforacourseofstudyofmorethan6months,and

beapplyingforleaveatthesametimeasthefamilymember.

34.Tier4(General)studentswhowillbestudyingintheUKforsixmonthsorlesscannotbring

theirpartnersand/orchildren(alsoknownasdependants)totheUnitedKingdomwiththem.

35.IfyouareachildbornintheUKtoaPBSmigrantandtheirdependantpartner,youwillneedto

submitafullUKBirthCerticateshowingthenamesofbothofyourparents.

36.You will have the following conditions attached to any leave:

Norecoursetopublicfunds,

Registrationwiththepolice,ifthisisrequiredbyparagraph326oftheImmigration

Rules,

NoEmploymentasaDoctororDentistinTraining,unlessyou:

haveobtainedaprimarydegreeinmedicineordentistryfromaUKinstitutionthatis

aUKrecognisedorlistedbody,orwhichholdsasponsorlicenceunderTier4ofthe

Points Based System; or

areapplyingforleavetoremainandhave,orhavelastbeengranted,entryclearance,

leavetoenterorleavetoremainthatwasnotsubjecttoaconditionrestricting

youremployment,whetherthatisemploymentasaDoctororDentistinTraining

orotherwise,andhavebeenemployedduringthatleaveasaDoctororDentistin

Training.

37.IfyouarethefamilymemberofaTier4(General)Student,ifthemainapplicantsgrantof

leaveisforlessthan12monthsyouwillnotbeallowedtoworkwhilstintheUK,unlessthemain

applicantisaGovernmentSponsoredStudent.

38.IfyouarethefamilymemberofaTier4(General)student,ifthemainapplicantsgrantofleaveisforacourseofstudybelowdegreelevel,youwillnotbeallowedtoworkwhilstintheUK.

39.Inordertobegrantedentryclearanceasaspouse,civilpartner,unmarriedorsamesex

partner,youandthemainapplicantmustbeaged18oroveronthedateyouareduetoarrivein

theUnitedKingdom.

40.AllarrangementsforchildrenscareandaccommodationintheUnitedKingdommustcomply

withrelevantUnitedKingdomlegislationandregulations.Moreinformationcanbefoundonthe

41.IfyouhavebeenworkingasaDoctororDentistinTrainingduringyourmostrecentperiodofleave,youshouldsubmitthedocumentsspeciedinAnnexAofthisguidance.Ifyoudonot

includealloftherequestedinformation,anygrantofleavewillbesubjecttotheDoctororDentist

in Training restriction.

Maintenance RequiReMent

42.Pleaserefertoparagraphs319C,319HandappendixEoftheImmigrationRules.

43.OneoftherequirementsforfamilymembersofPointsBasedSystemMigrantsisthatyoumust

beabletosupportyourselffortheentiredurationofyourstayintheUKwithoutneedinghelpfrom

publicfunds(forexamplebenetsprovidedbythestate).Ifyoucannot,youcouldfacenancial

hardshipbecauseyouwillnothaveaccesstomoststatebenets.

44.IftheTier1MigrantisoutsidetheUnitedKingdomorhasbeenpresentintheUnitedKingdom

forlessthan12months,youmustshowthatyou,theTier1Migrant,or(forchildren)yourother

parentwhoisalsolegallypresentintheUnitedKingdomhaveatleast1800tosupportyou;thisisinadditiontoanyfundstheTier1Migrantneedstoprovetheyhaveenoughmoneytosupport

themselves.PleasenotedependantsofTier1(Investors)andTier1(ExceptionalTalent)donot

needtosatisfythemaintenancerequirement.

45.IftheTier1MigranthasbeenintheUnitedKingdomfor12monthsormore,youmusthave

600tosupportyourself.

46.Forexample,theTier1MigranthasbeenintheUKfor6monthsandismakinganapplication

atthesametimeastheirspouseandtwochildren.Theymustshowthattheyhave1800forhis

spouseandafurther1800foreachchild,inadditionto900requiredfortheirownsupport.In

totalthefamilywillrequireevidencethattheyhold6300inavailablefunds(1800x3=5400+

900).47.IfthesameTier1MigrantandtheirfamilyhadbeenpresentintheUKfortwoyears,they

wouldrequireevidencethattheyheld2700(600x3=1800+900)inavailablefunds.

48.Youmusthave600tosupportyourself.

49.Thisrequirementcanbemetby:

havingsavingsof600whichmusthavebeenheldforatleastthreemonthspriortothe

date of application; or

theTier2A-ratedsponsorprovidingawrittenundertakingthat,shoulditbecome

necessary,itwillmaintainandaccommodatethefamilymemberforamonth.Theundertakingmay
