     has held that this deparure ar" does not apply ithn the context of statutory otions to reopen ade in reoal proceedngs. arciaCarias v Holder 697 F3d 257 263 (5th Cir. 2012) (Section 229a(c)(7) unabiguously gives aliens a right to le a otion to reopen regardless of hether they have le the Unted States") Hoever, this authoity does not extend to sua sponte otions to reopen, hch are regulatory by nature and subject to the depare barGarca-Carias  697 F.3d at 263; Ovalles v Holder 577 F.3d 288 (5th Cir. 2009); NavarroMiranda v. Ashcrof  330 F3d 672 (5th Cr 2003)

     Respondent has already been reoved to Mexico see See Respondents Motion to Reopen at 3, pusuant to a properly issued nal Order of Reoval See Order of the Iigratonudge. As a result, the Cou does not have jursdicton to consider hs request r sua spone reopenng See Garcia-Carias  697 F3d at 263
