New law for universities

The act - basic information

• Doctoral education shall prepare them for obtaining a degree of doktor and take place at a doctoral School (art. 198 sec. 1)Kształcenie doktorantów przygotowuje do uzyskania stopnia doktora i odbywa się w szkole doktorskiej (art. 198 ust. 1)

• The doctoral school shall be an organised form of education in at least two of the disciplines (art. 198 sec. 2)Szkoła doktorska jest zorganizowaną formą kształcenia w co najmniej 2 dyscyplinach (art. 198 ust. 2)

• The doctoral school may be run by a university-type higher education institution with scientific category A+, A or B+ in at least two disciplines (art. 198 sec. 3) Szkoła doktorska może być prowadzona przez uczelnię akademicką (…) posiadające kategorię naukową A+, A albo B+ w co najmniej 2 dyscyplinach (art. 198 ust. 3)

The act – recruitment

• Recruitment to the doctoral school shall be conducted by means of a competition on the basis of the rules defined by the senate or the scientific council (art. 200 sec. 2)Rekrutacja do szkoły doktorskiej odbywa się w drodze konkursu na zasadach określonych przez senat (art. 200 ust. 2)

• At the same time, one person may only be a doctoral student at one doctoral school (art. 200 sec. 7)Jednocześnie można być doktorantem tylko w jednej szkole doktorskiej (art. 200 ust. 7)

The act – individual research plan and mid-term evaluation

• Doctoral students, in consultation with the doctoral student supervisor (for the preparation of the doctoral dissertation and they shall submit it to the entity operating the doctoral school within 12 months of the date of the commencement of education. If an assistant supervisor is appointed, the plan shall be presented after the provision of opinion by that supervisor (art. 202 sec. 1)Doktorant, w uzgodnieniu z promotorem lub promotorami, opracowuje indywidualny plan badawczy zawierający w szczególności harmonogram przygotowania rozprawy doktorskiej i przedstawia go podmiotowi prowadzącemu szkołę doktorską w terminie 12 miesięcy od dnia rozpoczęcia kształcenia (art. 202 ust. 1)

• The implementation of the plan shall be subject to mid-term evaluation in the middle of the period of education defined in the curriculum (art. 202 sec. 2)Realizacja planu podlega ocenie śródokresowej w połowie okresu kształcenia (art. 202 ust. 2)

The act – individual research plan and mid-term evaluation

• The mid-term evaluation shall end with a positive or negative result. The result of the evaluation, together with the justification, shall be public (art. 202 sec. 3)Ocena śródokresowa kończy się wynikiem pozytywnym albo negatywnym. Wynik oceny wraz z uzasadnieniem jest jawny (art. 202 ust. 3)

• Mid-term evaluation shall be conducted by a committee composed of three members, including at least one person employed outside the entity operating the doctoral school (art. 202 sec. 4)Ocena śródokresowa jest przeprowadzana przez komisję, w skład której wchodzą 3 osoby, w tym co najmniej 1 osoba (…) zatrudniona poza podmiotem prowadzącym szkołę doktorską (art. 202 ust. 4)

• A doctoral student who does not hold a degree of doktor shall receive a doctoral scholarship(art. 209 sec. 1)Doktorant nieposiadający stopnia doktora otrzymuje stypendium doktoranckie (art 209. ust. 1)

• A doctoral scholarship is not awarded to a doctoral student receiving remuneration in the amount of at least 150% of the doctoral scholarship (...) for employment in connection with the implementation of a research project (...) by the entity running the doctoral school in which the doctoral student is studying, during this employment (art. 209 sec. 1a)Stypendium doktoranckiego nie otrzymuje doktorant pobierający wynagrodzenie w wysokości co najmniej 150% wysokości stypendium doktoranckiego (…) z tytułu zatrudnienia w związku z realizacją projektu badawczego (…) przez podmiot prowadzący szkołę doktorską, w której kształci się doktorant, w okresie tego zatrudnienia (art 209. ust. 1a)

• The total period of receiving the doctoral scholarship at doctoral schools shall not exceed 4 years(art. 209 sec. 2)Łączny okres otrzymywania stypendium doktoranckiego w szkołach doktorskich nie może przekroczyć 4 lat (art 209. ust. 2)

• The amount of a monthly doctoral scholarship shall be at least (art. 209 sec. 4) :

1) 37% of a professor’s salary – up to the month in which the mid-term evaluation was conducted

2) 57% of a professor’s salary – after the month in which the mid-term evaluation was conducted

• Wysokość miesięcznego stypendium doktoranckiego wynosi co najmniej (art 209. ust. 4):

1) 37% wynagrodzenia profesora – do miesiąca, w którym została przeprowadzona ocena śródokresowa

2) 57% wynagrodzenia profesora – po miesiącu, w którym została przeprowadzona ocena śródokresowa

• The amount of the doctoral scholarship may depend on the student’s achievements (art. 209 sec. 5)Wysokość stypendium doktoranckiego może być uzależniona od osiągnięć doktoranta (art 209. ust. 5)

The act – scholarship

• A doctoral student who submits their doctoral dissertation earlier than the date of completion of education provided for in the curriculum shall receive the doctoral scholarship until the date of expiry of the deadline for the completion of education, but not longer than for six months. The provision of sec. 2 shall apply (art. 209 sec. 8)Doktorant, który złożył rozprawę doktorską w terminie wcześniejszym niż termin ukończenia kształcenia przewidziany w programie kształcenia, otrzymuje stypendium doktoranckie do dnia, w którym upływa termin ukończenia kształcenia, jednak nie dłużej niż przez 6 miesięcy (art 209. ust. 8)

The act – scholarship and employment

• A doctoral student may not be employed as an academic teacher or researcher. The aforementioned shall not apply to the of a doctoral student (art. 209 sec. 10):

1) for the purpose of implementation of the research project (…)

2) after a mid-term evaluation with a positive result, except that in the case of employment for more than half of the full-time equivalent, the scholarship shall amount to 40% of the monthly scholarship referred to in sec. 4 point 2

• Doktorant nie może być zatrudniony jako nauczyciel akademicki ani pracownik naukowy. Zakaz nie dotyczy zatrudnienia doktoranta (art 209. ust. 10) :

1) w celu realizacji projektu badawczego (…)

2) po ocenie śródokresowej zakończonej wynikiem pozytywnym, z tym że w przypadku zatrudnienia w wymiarze przekraczającym połowę pełnego wymiaru czasu pracy, wysokość stypendium wynosi 40% wysokości miesięcznego stypendium

The act – doctoral student obligations

• A doctoral student shall be obliged to follow the regulations of the doctoral school (art. 207 sec. 1)Doktorant jest obowiązany postępować zgodnie z regulaminem szkoły doktorskiej (art. 207 ust. 1)

• A doctoral student shall be obliged to implement the curriculum and individual research plan (art. 207 sec. 2)Doktorant jest obowiązany do realizacji programu kształcenia i indywidualnego planu badawczego (art. 207 ust. 2)

The act – removal

• A doctoral student shall be removed from the register of doctoral students in case of: (art. 203 sec. 1):

1) a negative result of the mid-term evaluation

2) failure to submit a doctoral dissertation within the deadline specified in the individual research plan

3) opting out of further education

• Doktoranta skreśla się z listy doktorantów w przypadku (art. 203 ust. 1):

1) negatywnego wyniku oceny śródokresowej

2) niezłożenia rozprawy doktorskiej w terminie określonym w indywidualnym planie badawczym

3) rezygnacji z kształcenia

The act – removal

• A doctoral student may be removed from the register of doctoral students in case of: (art. 203 sec. 2):

1) unsatisfactory progress in the preparation of their doctoral dissertation

2) failure to comply with the obligations referred to in Art. 207 (more details in regulations of doctoral school)

• Doktorant może być skreślony z listy doktorantów w przypadku (art. 203 ust. 2):

1) niezadowalającego postępu w przygotowaniu rozprawy doktorskiej

2) niewywiązywania się z obowiązków, o których mowa w art. 207 (zapisy regulaminu szkoły doktorskiej)

• Removal from the register of doctoral students shall be effected by way of an administrative decision. The decision shall be subject to a motion for reconsideration (art. 203 sec. 3)Skreślenie z listy doktorantów następuje w drodze decyzji administracyjnej. Od decyzji przysługuje wniosek o ponowne rozpatrzenie sprawy (art. 203 ust. 3)

The act – end of education in doctoral school

• The education of a doctoral student shall end with the submission of their dissertation (art. 204 sec. 1)Kształcenie doktoranta kończy się złożeniem rozprawy doktorskiej (art. 204 ust. 1)

• The individual research plan shall specify the deadline for submission of the doctoral dissertation. This deadline may be extended, but by no longer than two years, pursuant to the rules laid down in the regulations of the doctoral school (art. 204 sec. 2)Indywidualny plan badawczy określa termin złożenia rozprawy doktorskiej. Termin ten może być przedłużony, nie dłużej jednak niż o 2 lata, na zasadach określonych w regulaminie szkoły doktorskiej (art. 204 ust. 2)

• At the request of a doctoral student, education shall be suspended for the period corresponding to the duration of maternity leave, leave on the conditions of maternity leave, paternity leave and parental leave (art. 204 sec. 3)Kształcenie, na wniosek doktoranta, jest zawieszane na okres odpowiadający czasowi trwania urlopu macierzyńskiego, urlopu na warunkach urlopu macierzyńskiego, urlopu ojcowskiego oraz urlopu rodzicielskiego, określonych w ustawie Kodeks pracy (art. 204 ust. 3)

• A doctoral student shall be entitled to rest breaks of up to 8 weeks per year (art. 208 sec. 1)Doktorantowi przysługuje prawo do przerw wypoczynkowych w wymiarze nieprzekraczającym 8 tygodni w roku (art. 208 ust. 1)

• In the case of a doctoral student who has obtained the degree of doktor as a result of graduation from a doctoral school, the period of education at that school, not exceeding four years, shall be included in the period of work on which employee entitlements depend (art. 208 sec. 2)Doktorantowi, który uzyskał stopień doktora w wyniku ukończenia szkoły doktorskiej, okres kształcenia w tej szkole, nie dłuższy niż 4 lata, zalicza się do okresu pracy, od którego zależą uprawnienia pracownicze (art. 208 ust. 2)

• The entity operating the doctoral school shall issue a doctoral student ID to the doctoral student(art. 208 sec. 4)Podmiot prowadzący szkołę doktorską wydaje doktorantowi legitymację doktoranta (art. 208 ust. 4)

• In the case of a doctoral student who has not completed education at a doctoral school due to (art. 208 sec. 3):

1) taking up of employment as an academic teacher or researcher,

2) discontinuation of education for doctoral students in a given discipline

the period of education at this school, not exceeding 4 years, shall be included in the period of work on which employee entitlements depend, provided that they have obtained a degree of doktor

• Doktorantowi, który nie ukończył kształcenia w szkole doktorskiej z powodu (art. 208 ust. 3):

1) podjęcia zatrudnienia w charakterze nauczyciela akademickiego lub pracownika naukowego,

2) zaprzestania kształcenia doktorantów w danej dyscyplinie

okres kształcenia w tej szkole, nie dłuższy niż 4 lata, zalicza się do okresu pracy, od którego zależą uprawnienia pracownicze, o ile uzyskał stopień doktora

• Within three months of taking up education, doctoral students shall be assigned a supervisor or supervisors (art. 201 sec. 2)W terminie 3 miesięcy od dnia podjęcia kształcenia doktorantowi wyznacza się promotora lub promotorów (art. 201 ust. 2)

• The scientific supervision of the preparation of a doctoral dissertation shall be exercised by the supervisor or supervisors or by the supervisor and assistant supervisor (art. 190 sec. 1)Opieka naukowa nad przygotowaniem rozprawy doktorskiej jest sprawowana przez promotora lub promotorów albo przez promotora i promotora pomocniczego (art. 190 ust. 1)

• A supervisor and reviewer may be a person holding a degree of doktor habilitowany or the title of profesor, and an assistant supervisor may be a person holding a degree of doktor (art. 190 sec. 4)Promotorem i recenzentem może być osoba posiadająca stopień doktora habilitowanego lub tytuł profesora, a promotorem pomocniczym – osoba posiadająca stopień doktora (art. 190 ust. 4)

• A supervisor and reviewer may be a person who does not meet the conditions set out in sec. 4 who is an employee of a foreign higher education institution or a research institution if the body (…)considers that the person has significant achievements in the scientific field associated with their doctoral dissertation (art. 190 sec. 5)Promotorem i recenzentem może być osoba niespełniająca warunków określonych w ust. 4, która jest pracownikiem zagranicznej uczelni lub instytucji naukowej, jeżeli organ (…) uzna, że osoba ta posiada znaczące osiągnięcia w zakresie zagadnień naukowych, których dotyczy rozprawa doktorska (art. 190 ust. 5)

The act – PhD (doktor) degree

• A degree of doktor (PhD)shall be awarded to an individual who (art. 186 sec. 1):

1) holds a magister or a magister inżynier degree or an equivalent degree

2) achieved the learning outcomes for qualifications at level 8 of the Polish Qualifications Framework, where the learning outcomes in terms of the knowledge of a modern foreign language are confirmed by a certificate or diploma confirming the knowledge of that language at B2 level or higher;

• Stopień doktora nadaje się osobie, która (art. 186 ust. 1):

1) posiada tytuł zawodowy magistra, magistra inżyniera

2) uzyskała efekty uczenia się dla kwalifikacji na poziomie 8 PRK, efekty uczenia się w zakresie znajomości nowożytnego języka obcego są potwierdzone certyfikatem na poziomie biegłości językowej co najmniej B2

The act – PhD (doktor) degree

• A degree of doktor (PhD)shall be awarded to an individual who (art. 186 sec. 1):

3) has at least:

a) 1 scientific article published in a scientific journal or in conference proceedings (ministerial list), or

b) 1 scientific monograph (ministerial list)

4) presented and defended a doctoral dissertation

• Stopień doktora nadaje się osobie, która (art. 186 ust. 1):

3) posiada w dorobku co najmniej:

a) 1 artykuł naukowy opublikowany w czasopiśmie naukowym lub w recenzowanych materiałach z konferencji międzynarodowej (lista ministerialna), lub

b) 1 monografię naukową wydaną przez wydawnictwo (lista ministerialna)

4) przedstawiła i obroniła rozprawę doktorską

The act – doctoral dissertation

• The doctoral dissertation demonstrates the candidate’s general theoretical knowledge in a discipline (or disciplines) and the ability to conduct research or artistic work independently (art. 187 sec. 1)Rozprawa doktorska prezentuje ogólną wiedzę teoretyczną kandydata w dyscyplinie albo dyscyplinach oraz umiejętność samodzielnego prowadzenia pracy naukowej (art. 187 ust. 1)

• The subject matter of the doctoral dissertation shall be an original solution to a scientific problem or in terms of the application of results of own scientific research in the economic or social sphere, or an original artistic achievement (art. 187 sec. 2)Przedmiotem rozprawy doktorskiej jest oryginalne rozwiązanie problemu naukowego, oryginalne rozwiązanie w zakresie zastosowania wyników własnych badań naukowych w sferze gospodarczej lub społecznej (art. 187 ust. 2)

• The doctoral dissertation may be a written dissertation, including a scientific monograph; a collection of published and thematically related scientific articles; design, construction, technological, implementation or artistic work; as well as an independent and separate part of a collective work(art. 187 sec. 3)Rozprawę doktorską może stanowić praca pisemna, w tym monografia naukowa, zbiór opublikowanych i powiązanych tematycznie artykułów naukowych, praca projektowa, konstrukcyjna, technologiczna, wdrożeniowa (art. 187 ust. 3)

• The doctoral dissertation shall include an abstract in English, whereas a doctoral dissertation prepared in a foreign language – an abstract in Polish. In the case when the dissertation is not in written form, its description in Polish and English shall be attached (art. 187 sec. 4)Do rozprawy doktorskiej dołącza się streszczenie w języku angielskim, a do rozprawy doktorskiej przygotowanej w języku obcym również streszczenie w języku polskim (art. 187 ust. 4)

The act – award of a degree of doktor (PhD)

• The proceedings for the award of a degree of doktor shall be initiated at the request of a person who satisfies the requirements set out in Art. 186 (…). The application shall be accompanied by a doctoral dissertation with a positive opinion of the supervisor or supervisors (art. 189)Postępowanie w sprawie nadania stopnia doktora wszczyna się na wniosek osoby spełniającej wymagania określone w art. 186 (…). Do wniosku dołącza się rozprawę doktorską wraz z pozytywną opinią promotora lub promotorów (art. 189)

• In the proceedings for the award of the degree of doktor, 3 reviewers shall be appointed from among persons who are not employees of the entity awarding a degree of doktor and the higher education institution (…), in which the person applying for the degree of doktor is employed (art. 190 sec. 2)W postępowaniu w sprawie nadania stopnia doktora wyznacza się 3 recenzentów spośród osób niebędących pracownikami podmiotu doktoryzującego oraz uczelni (…), których pracownikiem jest osoba ubiegająca się o stopień doktora (art. 190 ust. 2)

• Reviewers shall review the doctoral dissertation within 2 months of its provision (art. 190 sec. 3)Recenzenci sporządzają recenzje rozprawy doktorskiej w terminie 2 miesięcy od dnia jej doręczenia (art. 190 ust. 3)

• In order to be allowed to defend a doctoral dissertation, a person must receive positive reviews from at least two reviewers and meet the requirements referred to in Art. 186 (art. 191 sec. 1)Do obrony rozprawy doktorskiej może być dopuszczona osoba, która uzyskała pozytywne recenzje od co najmniej 2 recenzentów oraz spełniła wymagania (…) (art. 191 ust. 1)

• A person applying for a degree of doktor in extramural mode shall submit an application for the appointment of a supervisor or supervisors before the commencement of the proceedings (art. 217)Osoba ubiegająca się o stopień doktora w trybie eksternistycznym przed wszczęciem postępowania składa wniosek o wyznaczenie promotora lub promotorów (art. 217)

The act – urlop na doktorat

• An employee who is not an academic teacher or researcher shall be entitled, at their request (art. 196 sec. 1):

1) to a leave to prepare a doctoral dissertation or to prepare for the defence of a doctoral dissertation, granted in a period agreed with the employer, amounting to 28 days, which are working days for that employee within the meaning of separate regulations, and

2) to an exemption from work to defend their doctoral dissertation

• Pracownikowi niebędącemu nauczycielem akademickim lub pracownikiem naukowym przysługuje, na jego wniosek (art. 196 ust. 1):

1) urlop na przygotowanie rozprawy doktorskiej lub na przygotowanie się do obrony rozprawy doktorskiej, udzielany w terminie uzgodnionym z pracodawcą, w wymiarze 28 dni, które w rozumieniu odrębnych przepisów są dla tego pracownika dniami pracy, oraz

2) zwolnienie od pracy na obronę rozprawy doktorskiej

• For the period of leave and exemption from work, the employee shall be entitled to remuneration calculated in the same manner as for the holiday leave (art. 196 sec . 2)Za okres urlopu oraz zwolnienia od pracy pracownikowi przysługuje wynagrodzenie ustalane jak za urlop wypoczynkowy (art. 196 ust. 2)

• The education of doctoral students at the WUST Doctoral School lasts 8 semesters and is conducted in scientific disciplines in which the University is authorized to award the academic degree of doktor(PhD)

• Training is suspended for a period corresponding to the duration of maternity leave, leave on the terms of maternity leave, paternity leave and parental leave.

• A person removed from the list of doctoral students is not entitled to resume education at the Doctoral School

Extension of education (two additional years)

• The dean, upon the request of a doctoral student with an opinion of the doctoral dissertation supervisor(s) or the doctoral dissertation supervisor and assistant supervisor, after consultation with an appropriate head of an educational discipline, may extend the time limit for the submission of the doctoral dissertation, particularly in the event of:

1) the necessity to conduct long-term research for the dissertation being prepared, carried out as part of the education at the Doctoral School;

2) due to a long-term illness;

3) the occurrence of random events;

4) the need for personal care of an ill family member;

5) the need to take personal care of a child up to the age of four or a child with a certified disability;

in total not longer than for two years

• Extension of the deadline for submission of the doctoral dissertation should be made only for the period anticipated for submission of the dissertation and may be renewed, as above, for a total not exceeding two years 39

Scholarships

• A doctoral student without a doctoral degree receives a doctoral scholarship, the scholarship is not refundable

• The total period of receiving a doctoral scholarship may not exceed 4 years (8 semesters)

• The monthly doctoral scholarship amounts to at least:

– 37% of the professor's minimum salary - up to the month in which the mid-term evaluation was carried out - gross PLN 2,371.70; about PLN 2,104.65 net

– 57% of the professor's minimum remuneration - after the month in which the mid-term evaluation was carried out - gross PLN 3,653.70; approx. PLN 3,242.29 net

• A doctoral student may additionally be employed in the following projects:

– NAWA, NCBiR, NCN, or others

– EU projects

Individual study plan

• The education of a doctoral student shall be conducted in accordance with an individual studyplan of an interdisciplinary nature, established by the doctoral student in cooperation with a supervisor for the first two years of education for the consecutive semester, and from the third year of education for the consecutive two semesters and approved by the appropriate head of the educational discipline and the dean

• In the first semester, an individual study plan is determined only by the doctoral student

• From the third semester onwards, the individual study plan is determined taking into account a schedule specified in the individual research plan

Individual study plan

• The individual study plan referred includes:

– an individual plan of the courses selected from the list of courses included in the curriculum

– a list of assigned apprenticeship trainings

– a concise description of the planned research constituting the development of a particular stage of the doctoral dissertation, e.g. literature studies, preparing the research stands, making preparations, measurements, models, constructions, devices, calculations, computer programs and elaboration of the obtained results - in accordance with the schedule specified in the individual research plan

– in addition, other forms of scientific activity

Reports on the completion of the individual study plan

Report on the completion of the individual study plan includes:

• information on the results of the realization of teaching classes covered by the educational programme

• the list of completed apprenticeship training

• information on the degree of completion of tasks specified in the individual study plan, not later than from the third semester

• list of scientific achievements, projects, awards, internships, etc.

Apprenticeship trainings (praktyki zawodowe)

• As part of the education programs, each doctoral student of the Doctoral School is obliged to carry out professional internships of 30-60-60-30 hours per year (for doctoral students starting 1.10.2021)

• Teaching internships are conducted in the faculty/department of the doctoral student's supervisor

• Apprenticeships may be conducted in the form of conducting classes or participating in their conducting

• There is a possibility of reducing the internship, e.g., in the case of trips abroad or the implementation of research projects. The final decision to reduce the number of internships at the is made by the Vice-Rector for Education, upon an application of a doctoral student supported by a supervisor and Dean

Mid-term evaluation

• The Committee shall carry out a mid-term evaluation of the implementation of an individual research plan of the doctoral student on the basis of:

– an individual research plan

– a written self-report of the mid-term evaluation, in which the doctoral student presents a report on the implementation of the individual research plan

– a 15-minute oral presentation of the doctoral student's academic achievements related to the completion of the dissertation

– a discussion with the doctoral student about his/her conducted research, described in the above documents and achievements, as well as about research plans specified in the individual research plan

• The mid-term evaluation ends with a positive or negative result. The result of the evaluation together with the justification is public

• In the case of a negative assessment, a doctoral student may, within seven days, petition Dean to have the assessment repeated along with a justification

PhD vs. doctoral school

• The only possibility of a positive finishing of the doctoral school is to submit a doctoral dissertation

• You can reach the end of the doctoral school (4th or 5th or 6th year) without a submitted doctoral dissertation, but then the doctoral student is removed from the doctoral school

• You can pursue a doctorate without doctoral school, as an assistant lecturer or a person from outside the university (extramural mode)

• In the case of extramural mode (without previous Doctoral School eduction and / or work at the university), a fee is required for the procedure of awarding the doctoral degree
