It is submitted by the Learned Counsel appearing on behalf of

the Ministry of Environment and Forest, Government of India on the

instructions having been received from the Standing Counsel for

MoEF that the affidavit which was sought has not been filed as the

Standing Counsel is out of Station. However, it is submitted that in

the instant case, awaiting the filing of the affidavit, the instructions

are that since the mineral in question is masonry stone in the existing

quantity for which EC has been granted, the lessee can be permitted

to remove the mineral which is lying in the form of waste /

overburden i.e. other than the millstone.

Further it is submitted that so far as enhanced quantity for

which EC has been applied for, the said mineral cannot be allowed to

be removed or used commercially till such time as EC is not granted.

Having noticed the aforesaid facts, we are of the view that as a

temporary measure, the Respondent N o. 12 may be permitted to

remove the waste / over burden of the masonry stone in addition to

the millstone.

It would be the duty of the Respondent No. 12 to identify and

apprise the Mining Engineer concerned of the area from where such

overburden / waste is sought to be removed. The Mining Engineer,

on being satisfied in all respect including accessibility and safety as

well as no harm being caused to the plantation that may have been

carried out and after relevant consideration shall demarcate such

areas for being permitted for removal of the overburden.

In the meanwhile, the MoEF will file their affidavit before this

Tribunal before the next date of hearing. The RSPCB shall also be

apprised by the Respondent No. 12 with regard to the area from

which such overburden is sought to be removed and in case the

RSPCB which is to direct observance of any additional condition in

accordance with law, they would be at liberty to convey the same of

the Respondent No. 12. The Respondent No. 12 shall separately

maintain the record in respect of such overburden being removed as

also the details with regard to the purpose to do the same.

Let the matter be listed on 28th July, 2015.
