    SUMMARYThis report seeks approval ofa resolution authorizing the City Administrator to waive thecompetitive bid process and to negotiate and execu te a contract with Berkeley PolicyAssociates in an amount not to exceed $1 73,000 to complete an outcome evaluation ofthe violence prevention programs ftinded by Measure Y from January 2005 to December2007. The outcom e evaluation report will be presented to City Council in conjunctionwith the reauthorization of violenc e preven tion contracts in April 2008 . The timing willallow City Council to review performance oftheviolence prevention programs at thesame time funding decisions are made for FY 2008-09 violence prevention services. Theresolution also authorizes in the contract with Berkeley Policy Associates theend offiscal year evaluation report on comm unity policing and violence prevention programsand services for FY 2007-08.Additionally, the resolution authorizes the appropriation of $75,000 of M easure Yevaluation services funds to the Department of Human Services to provide supplementaldata analysis and survey services in support oftheoutcome evaluation presented in April2008.

    FISCAL IMPACTFunds for the evaluation contract ($173,000) and additional data analysis and surveyservices ($75,000) are available in Public Safety Act/2004 Measure Y Fund (2251),Measure Y Evaluation Project (G261240). There is no impact on the General PurposeFund.BACKGROUNDThe Violence Prevention and Public Safety Act of 2004 (Measure Y) legislationstipulates that not less than 1% or more than 3% of Me asure Y funds appropriated toeach police service or social service program shall be set aside for the purpose ofindependent evaluation oftheprogram, including the number of people served and therate of crime or violence reduction achieved .The City Administrator's Office released a Request for Proposals (RFP) on September27 ,2005 for the FY 2006-07 evaluation of Measure Y's community policing andviolence prevention programs and services. Seven proposals were received. BerkeleyPolicy Associates (BPA) ranked first in both the proposal review and interview process.The Violence Prevention and Public Safety Ov ersight Com mittee voted unanimously torecommend to the City Council that BPA be selected as the independent evaluator. TheCity Council authorized the City Administrator to award the contract to BPA in March2006.BPA is a local, certified firm^ with extensive expe rience c onducting evaluations ofcomm unity based service organizations and youth social service programs. BPA led theviolence prevention programs component ofthe evaluation. BPA subcontracted withRAN D Corporation (RAN D) and Leapfrog Consulting for the contract. RAN D led theevaluation of the community policing component of the evaluation. Leapfrog Consultingprovided graphic facilitation for the logic model meetings with the violence preventionprogram providers.The FY 2006 -07 evaluation entitled Community Policing and Violence Prevention inOakland: Measure Yin Action was published to the public on D ecember 28 , 2007 and isbeing presented to the Public Safety Com mittee under separate cover. This firstevaluation report presents a process evaluation that do cuments and analyzes the earlydevelopment and actual implementation ofthecommunity policing and violenceprevention com ponents funded by Measure Y.Violence prevention program providers are in their second year of funding from MeasureY. A report will be presented to the Public Safety C omm ittee in April 2008 to requestauthorization for a third year of funding for providers who have performed successfullyin the first and second years. For this reason, staff is proposing two w ork products forBerkeley Policy Associates for the second year oftheevaluation . The first work product,an outcome ev aluation, will be presented to the Public Safety Com mittee in April 2008,

    in conjunction with the request for third year of funding for program p rovider s. Thisoutcome evaluation' will span from January 2005 to Decem ber 2007 to report on ho wwell the programs are working and to show the impacts m ade by the programs to-date.The second work product, a full end-of-fiscal year report on both the community policingand violence prevention com ponents will be presented to the Public Safety Comm ittee byBPA and RA ND in the fall of2008.KEY ISSUES AND IMPA CTSThe proposed contract would provide an outcome evaluation on or before April 15, 2008,enabling informed funding decisions for the third year of Measure Y funding for violenceprevention program providers. The outcome evaluation will describe the impact of the$25,578,868 in Measure Y violence prevention program ming funds that have beenexpended from FY 2005-06 through FY 2006-07.A waiver ofthecomp etitive b idding process can occur only wh ere there is a finding bythe City Cou ncil or its designee that it is in the best interests of the City. Berkeley PolicyAssociates recently com pleted the first year process evaluation of M easure Y comm unitypolicing and violence prevention programm ing. BP A's familiarity with Measure Yviolence prevention strategies and grantees, the need to comply w ith the Measure Ylegislation's requirement for evaluation in a timely manner, and the desire for an outcomeevaluation prior to the next round of funding decisions, merit the request to waive thecompetitive bid process and to authorize the City Administrator to negotiate and executea contract with BPA for an outcome evaluation in April 2008 and an end-of-fiscal yearreport in fall 2008.

    The proposed $75,000 will fund one full-time, temporary, in-house staff position untilJune 200 8, to support the BPA evaluation efforts on the violence prevention programside. The position will ensure the transfer of confidential data for ma tching am ong allpartners - CitySpan, Oakland Unified School District, Alameda C ounty ProbationDepartment and the evaluation team. The position will work with CitySpan and granteesto ensure accurate and timely submission of data to the database for outcome analysis.The position will also provide day-to-day oversight of BPA analysis including review ofclient and provider surveys, review of assumptions for data analysis, collection of currentevaluation reports and data already undertaken by grantees.While the items identified in this report are being accomplished, the City Administrator'sOffice will develop and release a Request for Proposal (RFP) for Measure Y EvaluationServices for FY 2008 -09. This will provide stafftheopportunity to reflect on what wasaccomplished in the first two years of evaluation of Measure Y and survey other qualifiedevaluators for the next round of funding to ensure uninterrupted outcome evaluationservices and to ensure the most thorough, thoughtful evaluation is conducted of theviolence prevention and community policing components of Measure Y.

The outcome evaluation w ill provide data-driven analysis of the impact,efficacy and effectiveness of Measure Y violence prevention program ming.

    WHEREAS, City of Oakland voters passed Measure Y - the Violence Prevention andPublic Safety Act of 2004 ~ to provide tax revenue each year for ten years to supportviolence prevention and public safety programs and services in Oa kland 'sneighborhoods; andW H E R E A S, the Violence Prevention and Public Safety Act of2004stipulates that notless than 1% or more than 3% of funds appropriated to any police service or socialservice progra m shall be set aside for the purpose of an annual independent evaluation ofthe program, including the num ber of people served and the rate of crime or violencereduction achieved; and

    WHEREAS, City staff developed and disseminated a Request for Proposals inSeptember 2005 and conducted a proposal review and selection process to identify acontractor to provide evaluation services; andWHEREAS, the selected contractor, Berkeley Policy Associates (BPA) completedperformance under the 2005 evaluation contract and provided the first year evaluationreport, entitled Comm unitv Policing and Violence Prevention in Oakland. M easure Y inAction; andWHEREAS, due to its familiarity with the Measure Y Violence Prevention Programs,Berkeley Policy Associates can prov ide an outcome evaluation prior to the fundingdecisions for the third year of violence prevention programming funded by Measure Y;andWHEREAS, the City Administrator wishes to enter into an agreement with BerkeleyPolicy Associates without com petitive bid to provide (1) an outcome evalu ation of theMeasure Y violence prevention programs for FY 2005-06 and FY 2006 -07 and (2) anEnd of Fiscal Year 2007-2008 Report on Measure Y Com munity Policing and ViolencePrevention Programs; andW H E R EA S, the City Council finds the waiver of the competitive bid process is in thebest interests oftheCity; andWHEREAS, the City Cotincil finds that the service is ofaprofessional, scientific ortechnical nature and is temporary in nature; andW H E R EA S, the City Council finds that the contract shall not result in the loss ofemploym ent or salary by any person h aving permanen t status in the com petitive service;now therefore be itR ES OL V ED : That the City Adm inistrator or her designee is hereby authorized tonegotiate and execute a contract with B erkeley Policy Associates in an amou nt not toexceed $173 ,000, (Measure Y Evaluation Project (G261240), FY 2007-20 08) to (1)conduct an outcome evaluation of the Measure Y Violence Prevention Programs and (2)provide an End of Fiscal Year 2007-20 08 R eport on the Measure Y Comm unity Policingand Violence Prevention Prog rams; and be itFU R TH ER RE SO LV ED : That pursuant to Oakland Municipal Code Title 2, Chapter2.04, Article 2.0 4.05 l.B, the City Cou ncil finds and determines that it is in the bestinterests of the City to waive the competitive bid process for completion of the MeasureY outcome evaluation by Berkeley Policy Associates; and be itFU RT HE R RE SO LV ED : That the City Administrator is hereby authorized to conductall negotiations, execute and submit all documents, including, but not limited toapplications, agreements, amendm ents, modifications, payment requests and related
