    AUTHORIZING THE AMENDMENT OF CERTAINSECTIONS OF CHAPTER 5, ARTICLE 23, OF THEOAKLAND MUNICIPAL CODE PROVIDING FORCLARIFICATION AND INCREASE OF THE UTILITY USERSTAX.

    WHER EAS, theCouncil of the City of Oakland adopted Chapter 5, Article 23, ofthe Oakland Municipal Code ("the Code") providing for the taxation of persons usingintrastate telephone, gas, electricity services, cable television, all international andinterstate telecommunications and alternate fuel consumption; and

    WHEREAS, the City wishes to increase the utility user's tax for all categories ofutility consumption except those persons qualifying for the low-income rate assistanceprogram (LIRA) offered by the Pacific Gas & Electric Corporation ("PG&E"); and

    WHEREAS,the City wishes to reiterate and confirm that "telecommunications",as used in the Code, refers to all vocal, electronic, and facsimile transfers includingthose made using cellular and other mobile telephonic devices.

    The Council of the City of Oakland does ordain as follows:

    Section 1. Section 5-23.03 is hereby amended as follows:

    SEC. 5-23.03 TELEPHONE USERS TAX IMPOSED.

    (a) There is hereby imposed a tax upon every person with a service addressin the City, other than a telephone corporation (as defined by and licensed by theCalifornia Public Utilities Commission), using intrastate, interstate, or internationaltelephone communication services including, but not limited to, cellular telephonesand facsimile transmissions for communications originating or terminating in the City.The tax imposed by this section shall be at the rate of six and eight tenths porcont(6.80%) seven and one-half percent (7.50%) all charges made for such services andshall be paid by the person receiving such services, and collected by the provider ofsuch services.
