Terms of this agreement
1. Definitions
Within this agreement the following words or phrases shall, unless the context otherwise
requires, have the following meanings:
“Property” The property address for which you have instructed us to sell as stated at
the end of this agreement under the term “Selling address”.
“Commission” The amount payable to Simply4property in respect of our fees due from
the introduction of a buyer who legally completed on the purchase of your
property.
“Sale Price” The price agreed with your buyer for the sale of the property.
“Buyer” The person buying your property
“Seller” The owner of the property or the person who is entitled to sell the property
“You” The owner of the property or the person entitled to sell the property
“Simply4property” or “We” Means Simply4property of 53 Crown Street, Brentwood, Essex,
CM14 4BD.

2. Fee Payable to Simply4property
2.1 Any sum payable by one party to the other under these terms and conditions will be
inclusive of any VAT which may be chargeable at the rate for the time being prescribed by
law.
2.2 The agency agreement shall run from the date of signing this agreement until terminated
or varied by either party by 14 days’ notice in writing.
3. The seller hereby warrants that he/she:
3.1 has the necessary authority and capacity to enter into this agreement; and
3.1.2 is the beneficial owner of the property; or has the authority from the beneficial owner to
sell the property on the above terms;
4. Simply4property charge a “Fixed Sellers Fee” of £399 plus VAT for our ‘Classic’ Package
and £500 plus VAT for our ‘Classic Plus’ Package to produce your property particulars and
market your property. This is a non-refundable, one-off charge.
5. Simply4property will, if instructed and paid for by you either as an addition to the ‘Classic’
Package or part of the ‘Classic Plus’ Package, supply you with a “For Sale” board at the
property for sale. Once the board has been delivered it becomes your own property. You will
be charged £50 per additional For Sale board that you require.
6. If you have purchased our ‘Classic Plus Package’ Simply4property shall prepare and send
out sales memorandum letters on your behalf and on behalf of the prospective purchaser of
your property, these letters shall be sent to both sets of solicitors involved and a copy shall
also be sent to you, the seller, and your prospective purchaser.
7. Simply4property shall prepare a set of property particulars on your behalf, however
Simply4property are not responsible for any of the data that it provides to buyers and sellers.

cannot be guaranteed and they do not form part of any contract. You must approve your
property details before marketing of the property can commence.
8. Simply4property guarantees that your property is listed on the Simply4property website
which is www.simply4property.co.uk. Third party websites are subject to change, they may
not be controlled by Simply4property and we do not guarantee continued presence on these
websites, although it is the policy of Simply4property to continue to maintain, expand and
improve our property portal networks at all times.

Deposit – This simple word has two common meanings in connection with purchase of
property. The first general reference to a ‘deposit’ can often mean no more than the personal
contribution towards the price of the property – in other words, it is the difference between the
purchase price and the amount of mortgage being borrowed. The second refers to the contract
drawn up for the sale which normally requires payment of a ‘deposit’ at the time contracts are
exchanged. This contract deposit will usually be 10% of the purchase price.
Earnest money – deposit, applied to the purchase price or forfeited if the purchaser fails to
carry out the terms of the agreement
Commission – This is the fee which an estate agent charges for arranging the sale. Many
estate agents advertise that they will cut their fees, but this must also mean some equivalent
cut in the work they undertake – one cannot offer a fully comprehensive estate agency
service, efficiently, on the cheap.
Easements – Easements are legal rights attached to the ownership of the property – for
example a right of way or some other legal benefit which the owner of the property enjoys
over an area of land not in his ownership. It is in some respects the reverse of a covenant.
Your easement over an adjoining property may be written into their Deeds in the form of a
covenant in your favour although these are not necessarily recorded by the Land Registry.
Your solicitor will check into the validity of those which apply to the property you are
thinking of buying.

1. What is your price range?
Before you can look at properties, you need to work out your price range. What is the
maximum amount you could borrow? How much could you afford to pay back each month?

Go to estate agents. Look through the property papers. Search for new for sale signs. When

4. Finalise mortgage application
With our advice, confirm the type of mortgage you require and we’ll complete the application

5. Choose a solicitor/conveyancer
Obtain quotes from solicitors/conveyancers and pick one. Often the best way to find a good
solicitor or conveyancer is by personal recommendation. (We can recommend solicitors if
you’d rather.) Keep in mind that it might be worth paying a bit more for a better service.
6. The application is assessed and the property is valued
Your lender will now need to assess your application. They also need to know that the

property is suitable for them to lend on. All lenders require a basic valuation, but you can
choose to have a more detailed survey such as a Home Buyers report or a Building survey. It

time as completing the basic valuation, so make sure you tell them in advance.
7. Receive your mortgage offer
Your mortgage application is agreed, and you will receive an offer letter from your lender.
This will detail exactly what they will lend you, and on what terms.
8. Contact your solicitor/conveyancer and arrange protection
Your solicitor/conveyancer will be finalising legal preparations. You should organise
buildings insurance and mortgage protection to be in place for the exchange date, as from this
date you are legally obliged to buy the property and will be liable for buildings cover.
9. Exchange contracts
Your solicitor/conveyancer will confirm that all other parties in the chain are ready, and you
will exchange contracts. Your deposit will now be paid. Normally your completion date will
be agreed on at this point.
10. Completion!
The funds will be released and you will get the keys to your new home!

Rental Contract
The Owner, known as ________________________________________________________,
rents the Resident, known as ___________________________________________________,
the dwelling located at __________________________________, for the period commencing
on the ____day of ________________, 20_____, and monthly thereafter until the last day of
_________________________, 20______, at which time this Agreement is terminated.
The Resident hereby agrees to the following terms:
1. RENT: The Resident agrees to pay as rental the sum of $_______________ per
month, due and payable in advance from the first day of every month. Failure to pay
rent when due will result in the Owner taking immediate legal action to evict the
Resident from the premises and seize the security deposit.
2. SECURITY DEPOSIT: The Resident agrees to pay a security deposit in the amount of
$______________ to secure the Resident’s pledge of full compliance with the terms
of this agreement. The deposit will be used at the end of the tenancy to compensate the
Owner for any damages or unpaid rent or charges.
3. METHOD OF PAYMENT: The initial payment of rent and deposit under this
agreement must be made in cash. Thereafter, monthly rent payments may be paid by
bank transfer to the following account: _________________________________
4. LATE FEE: Rent received after the first of the month will be subject to a late fee of
10% plus (3.00) dollars per day.
5. TERMINATION: After one month’s rental payment has been received, this agreement
may be terminated by mutual consent of the parties, or by either party giving written

notice of at least 15 days prior to the end of any monthly period. Any provision of this
agreement may be changed by the Owner in like manner.
6. RENEWAL TERM: At the end of initial term herein, as per page 1, the Owner may
elect to renew for another term but at a rental increase of 3% to 5% of current rental
rate depending on the market index.
7. ABANDONMENT: If Resident leaves said premises unoccupied for 15 days while
rent is due and unpaid, Owner is granted the right hereunder to take immediate
possession thereof and to exclude Resident there from; removing at his/her expense all
his/her property contained therein and placing it into storage at Resident’s expense.
8. EXTRA VISITORS: The Resident agrees to use said dwelling as living quarters only
for______ adults and _______ children, named ______________________________
and to pay $75.00 each month for each other person who shall occupy the premises in
any capacity other than visiting.
9. SUBLETTING: The Resident agrees not to assign this agreement, nor to sublet any
part of the property, nor to allow any other person to live therein other than as named
in paragraph 8. above without first requesting permission from the Owner and paying
the appropriate surcharge.
10. ACCEPTANCE OF PROPERTY: The Resident will be provided with an inspection
sheet. It is his/her obligation to inspect the premises and to fill out and return the
inspection sheet to the Owner within 3 days after taking possession of the premises. It
will be presumed that the house is functioning in a satisfactory manner in all respects
after the expiration of the 3 days.
11. The Resident further agrees to indemnify the Owner against any loss or liability
arising out of the Resident’s use of the property, including these using the property
with the Resident’s consent.
12. CLEANING: The Resident accepts premises in its current state of cleanliness and
agrees to return it in a like condition.
13. MAINTENANCE: The Resident agrees to maintain the premises during the period of
this agreement. This includes woodwork, floors, walls, furnishings and fixtures,
appliances, windows, screens, doors, lawns, landscaping and fences, as well as
plumbing, electrical, air conditioning, heating and mechanical systems. Tacks, nails,
or other hangers nailed or screwed into the walls or ceilings will be removed at the
termination of this agreement. Damage caused by rain, hail or wind as a result of
leaving windows or doors open, or damage caused by overflow of water, or stoppage

of waste pipes, breakage of glass, damage to screens, deterioration of lawns and
landscaping, whether caused by abuse or neglect is the responsibility of the Resident.
The Resident agrees to provide pest control in the event it is needed. The Resident
warrants that he/she will meet the above conditions in every respect, and
acknowledges that failure to do so will be grounds for termination of this agreement.
14. CODES: The Residents agrees to take affirmative action to insure that nothing exists
which might place the owner in violation of applicable building, housing and health
codes.
15. CONDUCT: The Resident agrees to conduct him/herself in a manner which will not
disturb others and to insure that his/her family, friends, guests and visitors conduct
themselves in the like manner.
16. OWNER’S PROPERTY: The Resident agrees to safeguard the Owner’s property
against damage, destruction, loss, removal and theft.
17. UTILITIES: The Resident shall be responsible for payments of all bills incurred
during their residency, including garbage, water and sewer charges, telephone,
electricity, gas and other bills. He/she specifically authorizes the Owner to deduct
amounts of unpaid bills from his/her deposit in the event they remain unpaid after the
termination of this agreement. The Resident agrees to transfer the gas, electric, and
water service charges to their name immediately upon occupancy and to make
arrangements for meter readings as needed.
18. REPAIRS: In the event repairs are needed beyond the competence of the Resident, he/
she is urged to arrange for professional assistance. The Resident should refrain from
contacting the Owner except for emergencies.
19. DEFAULT BY RESIDENT: Any breach or violation of any provision of this contract
by Resident or any untrue or misleading information in Resident’s application shall
give the Owner or his agent’s the right to terminate this contract, evict the Resident
and to take possession of the residence. The Resident agrees to a forfeiture of the
security deposit and Owner may still purse any remaining amounts due and owing.
20. RIGHT TO SIGN: The individual signing this Rental Agreement stipulates and
warrants that he/she has the right to sign for and to bind all occupants.
21. ACKNOWLEDGMENT: In this agreement the singular number where used will also
include the plural, the Masculine gender will include the Feminine, the term Owner
will include Landlord, Lesser, and the term Resident will include Tenant, Lessee. The
below-signed parties acknowledge that they have read and understand all of the

provisions of this agreement. This contract is bound by all heirs, executors, successors
