You are, I hope, sn re that the NRC has only recently, since it has beenseen to enforce its own safety and licensing regulations, begun to cli:nb out fromunder the oloud of lies, misinformation, and cover-tp secrecy which had underminedany faith knowledgable citizens had in the AEC and ERDA. It would be unfortunate if, atthis point, you wiped out your gafns as an agency truly concerned with the sm26and welfare of all the people of this country. The majority of American tax 3payers has no faith in the nuoloar industry's interest in their well- beingexcept as it can be a refloation of their faith that the NRC:isJ no lenger usrely~ .!-

that part of the government-industrial-military complex that has easy access toits packets.

Why, therefore, should you grant the CRBR organizatien an exemption fromrule 10 CFR 50,107 From the point of view of the industry the reason ta self-evident. Once,they have cleared ground, excavated foundations, and spent$88 million :noe dollars me=derr of our :noney, they would have an extra argumentfor getting their constructioh permit - with perhaps some waivers there, too?

And this would not be the first time that construction of the CRBR hasattempted, with the help of the ABC, to circumvent the law. In 1975 the AECbrushed aside NEPA and determined that contracts could be signed and i=plementedwithout an Environmental Impact Statement coveri36 the entire breeder reactorprogram which CRBR was to usher in. In fact, ERDA had requested-$181 millionfor the CRBR without even filing any EIS.

In the light of the 1973 confidential internal :nomorandom of Burns andRoe, Inc., the architect-Engineers of the Clinch River Breeder Reactor, onewould hope that the NRC would want to pay particular attention to site clearingandexcavationratherthanexemptingtheconsortiumfrcaruls10C7R50,10/The Burns and Roe memorandum, aside from charging unreliable ma q emest, neglectof important safety problems, diversien of funds, etc., specifically said of the

- -site of the CRBR that " varying rock conditions", " voids and cavities", and -

Tope stability" ... made it one of the worst sites ever selected for a nuolear'3 paar power plant," Based on topography and rock conditions; they stated more than

and Burns and Roe had been told orally by the Reactor /Divisien of EC and Fl:C,the h agement grouj, not to comply with the safety requirements "already in

_ mistence"; and the6 Burns and Roe make it clear in the 1973 document that eneof their major concerns is "that the corporate reputation not be damaged bythe results of the project, since it is in large nessure a key to our futuregrowth." And it is a fact that in spite of Burns and Roe's list of seriouscomplaints against the project the firm remained committed to its development, 1an understandable position when ERDA announced That Burns and Roe had been. ~

paid $37,4 million in fees as of September d 30, 1976. This, however, will -

not chan6e basic topography, rock formations, voids and cavities, and landslidepropensities in the cite - which merit your attention, not an exemption.

There was a time when there may have been genuine concern about thesufficiency of the supply of Uranium for the existing and to come IJFR's, whichwould necessitate reprocessing and breeder reactors. Doubt is cast on this,however, an view of the fact that the shortage figures came frem the AEC, andthe AEC's known interest in the breeder from the very beginning of the peacefuluse of the aton for energy. It OK'd the Fermi commercial denonstration breeder-to proceed to the design phase as early as December,1951, the same year thatits own Experimental Breeder number 1 (EBR-1) produced its first electricity- off"g ,,

enough to light 4 light bulbs. ( By1955ithadarunawayexcursionandmeltdown$The near catastrophe at Fermi in 1966 and the catalogue of mishaps both before segLL*-the accident and after did nothing to halt the AEC's obsessive interest in thebreeder. It was not ooincidence that CRBR was born i= mediately after tiis AEC

- gave up on Fermi and refused to extend its license to operate in 1972. It had-already chosen Oak Ridge as the site of a second demonstration breeder. And mwhat better way to get funding than a Uranium shortage scare.

However, the question of a Uranium shortage no longer applies as a reasonfor putting the CRBR on " fast track" that requires an emergency exemption fremrule 10 CFR 50,12. The projected level ofg nuclear power for the year 2000dropped 68 % between 1972 and 1977,2 and has no doubt continued to drop in theface of conservation,which has already created excess capacity; and theexcessive. capital costs of new plants, which is putting some utility companiesin financial straits - which will, of course be passed on to the consumers.

l| For these reasons, I urge you not to exempt the CRBR from rule 10 CFR 50.12.) The exemption would have no validity in itself and would, almost certainly,

be an inducement for further requests for exemptiens from other regulations by!

any company proposing to build a nuclear reactor.

We urge the NRC to deny the request fra the U.S. Department ofEnergy to exempt the Clinch River Breeder Reactor (CRER) fromcertain NRC licensing requirements.

At a time when public confidence in the NRC is rapidly eroding,it would be a mistake for the Consnission not to require fulllicesing for the CRBR. There is clearly no mandate from the USCongress concerning the CRER. Indeed, Congress is likely toterminate the project next session. The claim that there is anemergency situation which would warrent a special exemption forthe CRER is preposterous, considering declining electrical demund, and ?,

~'nationwide overcapacity.

Once again, we urge you to deny any request to exempt the Clinchi

On behalf of San the Breeder Committee, I write for the following reasons to oppose therequest of the Department of Energy to exempt the Clinch River Breeder Reactor (CRBR)from certain Nuclear Regulatory Commission licensing procedures:

1) To truncate the licensing procedure of the first commercial demonstration of'a breeder would be to undermine the alleged licensibility of CRBR and futurebreeder reactors.

2) Because of the uniquely dangerous and highly controversial aspects of CRBR,more, rather than less, care nust be taken to protect the public healthand safety. _ _ _._

3) Richard .L. Garwin, IBM Fellow & Professor, Harvard University, states "Recentprototype large breeder reactor (PLBR) studies in the United States estimatedthe capital cost of a breeder reactor to be at least $600 million more thanthat of an LWR. Present uranium costs of some $30/lb would have to rise some$130/lb before such a breeder could compete with the LWR, even if no economieswere achieved in LWR operation. One economy in the present fuel cycle that islikely within the next ten years is a reduction in the cost of isotopa enrich-ment from the present $80-100/kg SWU to around $20/kg SWU." Clearly, the de-cline in electrical demand coupled with the rise in uranium supplies demon-strates the " emergency" proposed by the DOE to short-cut the CRBR licensing .

I 'strongly oppose the proposal presently pending before the . '#I'to exempt the Clinch River Breeder Reactor (CRBR) from certainNRC licensing procedures. In the wake of the continuing problemsof Three Mile Island and the more recent " embarrassment" of DiabloCanyon there is no reasonable justification for these exemptions.The technology and economics of the breeder reactor are in flux,and it would be greatly detrimental to the public to put the CRBRon a " fast track" at this time.

There is no Congressional mandate for the proposed exemptions. Recentattempts to cut funding for CRBR lost by only slim margins in both theSenate and House.to the current mood of Congress, but also the general public. Adopting exemptions for CRBR is contrary not onlyfailures in breeder development have seriously undermined public confi-Priordence. This is clearly not the time for exemptions which would serveto foist a technology upon an unwilling and dubious public andeconomy.

I urge you to reject the proposed exemption.s.

I unaerstand the LC_is considering an exemption for the Clinch liverreeder Meactor Pro 1ect which would allow grounc breaking ano site

preparation on the project.

1 oppose the granting of such an exemption. My reasons for opposingthe exemption are as follows:

1. There is no energy emergency that would call for an exemption ~

at this time. The energy usage of our country is declining. Yetthe Breeders were planned when the projecticca were for increasin.Tenergy usage.

2. Congress is not strongly in favor of such a program. There isno clear voting mandate on this issue. In 1981 the amendment tocut the CHER Project lost & by Alq votes in the Senate and twentyvotes in the house.

3 Any type of exemption which will allow ground breaking andsite preparation (to the sum of $88 nillion dellars) on a projectwhich has neither a construction permit or a limited work author 1-zation would surely not set well with the public. . Shat littlepublic confidence the public has in any nuclear program wculd W scompletely eroded. . @ '/
