WHEREAS, it is deemed necessary to put in placelegal conditions which are conducive to enhance andstrengthen the land use right of farmers to encourage
.thei11take the necessary conservation measures in areas
where mixed farming of crop and animal production isprevalent and where there is threat of soil erosion andforest degradation;
WH EREAS, is has become necessary to establisha conducive system of rural land administration thatpromotes the conservatiQn and management of naturalresources, and encourages private investors inpastoralist areas wherethet'eis tribe based communallandholding system;
WHEREAS, Arti.cle 52 (2) (d) of the Constitutionstipulates that the power entrusted to regions toadminister land and natural resources is to beimplemented in accordance with the law to be enactedby the federal state;
NOW, THEREFORE, in accordance with Article55( I) of the Federal Democratic Republic of Ethiopia,it is hereby proclaimed as follows:

1. Short Title

2, Definition
In this Proclamation, unless the context requiresotherwise:
,1/ "rural land'. means any land outside of amunicipality holding or a town designated assuch by the relevant law;
2/ "rural land administration" means a proCf'<'<;whereby rural land holding security is provideo,land use planning is implernented, disputesbetween rural land holders are resolved anq therights and obligations of any rural l~lI1dholderare enforced, and information on farm plots andgrazing Land holders are gathered analyzed andsupplied to users;

5. Acqui!~itionand UseorRuml Land
1/ In accordance with land administration law:
a) Peasant ... farmers/pastoralists engaged inagriculture for a living shaH be given ruralland free of charge:
b) Any citizen ofthe country who is 18 yearsof age or above and wants.to engage inagriculture for a living shaH have the rightto use rural land; children who lost theirmothers and fathers due to death or othersituati<;m.shall have the right to use ruralland through legal. guardians until theyattain 18 years of age:
c) Women who want to engage in agricultureshall have the right to get and use ruralland.
2/ Any person who is member of a peasant farmer,Semi pastoralist and pastoralist family havingthe right to use rural land may get rural landfrom his family by donation, inheritance orfrom the competent authority,
3/ Government being the owner of rural land,commu,nal rural land holdings can be changedto private holdings aso1ay be necessary;
4/ subject to giving priority to peasant farmers/semipastoralists and pastoralist:
a) Private investors that engage in agriculturaldevelopment activities shaH have the rightto use rural land in accordance with tI,:,investment policies and laws at' federal andregional levels;
b) Governmental and non-governmentalorganizations and social and economicinstitutions shall have the right to use ruralland in line with their ',developmentobjectives.

1/ The sizes of rural lands under the holdings ofprivate persons, communities, governmentaland non-governf!1ental organizations shall bemeasured as appropriate using cultural andmodern measurem~nl equipment,s; their landuse and level of fertility shall be registered aswell in the data base center by thecompettsntauthorities established at all levels.
2/ Rural land holdings described under Sub-Article1 of this Article shall be measured by thecompetent authority and shall be givencadastral maps showing their boundaries
3/ Any holder of rural land shall be given holdingcertificate to be prepared by the competentauthority and that indicates size of the land,land use type and cover, level of fertility andboarders, as well as the obligation and right ofthe holder.
4/ Where land is jointly he.ld by husband and wifeor by other persons, the holding certificate shallbe prepared in the name of all the joint holders.
5/ The information that describes the holder of ruralland, the holders of the bordering lands, thetypes of use, and the rights and obligation ofthe holder thereof shall be registered in thedatabase and kept by the competent authority.
6/ Any rural land that is held through lease or rentalshall be registered by the competent authority.
7. Duration of Rural Land Use Right
II The Rural land use right of peasant farmers,semi-pastoralists and pastoralists shall have notime limit.
2/ The duration of rural land use right of otherholders shall be determined by the rural landadministration laws of regions.

31 Holder of rural land who is evicted for purposeof public use shall be given compensationproportional to the development he, has madeon the land and the property acquired, or shallbe given substitule land thereon. 8. Transfer of Rural Land Use Right
11 Peasant fanners, semi. pastoralist andnastoralist. who are given holding certificat~s can lease to
other farmers or investors land from theirholding of a size sufficient for, the intendeddevelopment in a manner that shall not displacethem, for a period of time to be determined byrural land administration laws of regions basedon pm1icular local conditions,
21 The. rural land lease agreement to be concludedin accordance with Sub-Article (I) of thisArticle shall secure the consent of all themembers who have the right to use the land andbe approved and registered by the competentauthority,
31 A landholder may, using his land use right,undertake development activity jointly with (i,1investor in accordance with the contract heconcludes. Such contract shall be approved andregistered by the competent authority.
41 An' investor who has leased rural land maypresent his use right as collateral.
51 Any holder shall have the right to transfer hisrural land use right through inheritance tomembers of his family,

PART F8URMISCELLANEOUS PROVISIONS
15, Rural Land Administration and use Study
A system of study that focuses on. identification ofproblems on land administration and use, andrecommends solutions shall be established.
The Federal Ministry of Agriculture and RuralDevelopment shall:
11 have the responsibility to implement thisProclamation by providing the necessaryprofessional support and by coordinating thecompetent authorities;
21 initiate, on the basis of the information gatheredat national level and those to be obtained fromtime to time through monitoring and evaluation,development of new policy ideas, and theamendment of the existing policy, as necessary;
3/ create the system for the exchange ofinformation between regions and the FederalGovernment pertaining to rural landadministration and use,
17, Responsibility of Regions
1I Each regional counciI shall enact rural landadministration and Land use law, whichconsists of detailed provisions necessary toimplement this Proclamation,
2/ Regions shall establish institutions at all levelsthat shall implement rural land administrationand Land use systems, and shall strengthen theinstitutions already established.

18. Obligation to Cooperate
Any person shall have the obligation to cooperatewith relevant bodies for the implementation of thisproclamation.
19. Penalty
Any person who violates this Proclamation or theregulations and directives issued for theimplementation of this Proclamation shall bepunishable under the applicable criminal law.
O. Repealed and Inapplicable laws
II The Federal Government Rural LandAdministration Proclamation No. 89/1997 ishereby repealed.
21 No law, regulation, directive or practice shall,in so far as it is inconsistent with thisProclamation, be applicable with respect ofmatters provided for in this proclamation
1. Effective Date
This Proclamation shall enter into force on this15thdate of July, 2005
