RESPONDING TO RENTAL ADVICEMatthew Mitchell's refreshing advice in his article, Understanding Rent and Rates in theCurrent Climate (Fashion Extras, August 2012), highlighted the importance of agreeing termsto limit liability for the state of repair and condition in which leasehold premises must bereturned to the landlord at the expiry of the contractual term. However, even better practice isto ensure that a reference to the schedule of condition is included in the clause in the tenancyagreement obliging the tenant to redecorate the premises at the end of the term. In this way,tenants can avoid the trap of neatly escaping the obligation to repair only to be caught out byan obligation to redecorate at the end of the term.
