General Style – Voice & Mood

The 2007 Specifications are written in the active voice andimperative mood for instructions to the Contractor.

Traditional style was in passive voice:Concrete shall be thoroughly consolidated against the faces of all  forms and joints, including concrete in a previously constructed lane of pavement, by means of vibrators inserted in the concrete.

New style – all commands are written to the Contractor:

Consolidate concrete against all form faces, joints, and previously constructed pavement using insertion type vibrators.

Where action or responsibility is for the Department,the specification will be written in the active voice andwill specifically name the Department.

Statement’s of fact are written using the indicativemood.

Section 101.03 Terms

If the term is capitalized, it is capitalized in the Specifications

• Change Order – term replaces “Construction Order” in keepingwith common usage.

• Contract – includes permits, boring logs, pavement core records

•  Extra Work - New Work and quantity adjustments to Items that are not the result of as-built measurement or calculation.

•  New Work - work directed by the Department that is not covered under an existing Item or combination of Items in the Contract.

• Field Order - Written direction, signed by the RE, requiringaction by the Contractor.

Section 104.02 Value Engineering

• The Department will not consider anticipated costsavings based on revisions to utility relocations or other work to be performed by Others.

• The Contractor is responsible to obtain theconcurrence of Utilities, property owners, governingbodies, and agencies for any work affected by theVE proposal.

• The Department has the right to reject VE proposalsthat may increase the time or cost of work done byOthers.

The Department will not use the value of costsavings for road user costs, or for the Department’sconstruction engineering costs.

Section 104.03 Change Orders

Protests to Change Orders - A protest is not a substitute for notice as specified in 104.03.04.

A protest is notice that the terms and conditions for proposedwork are not in accordance with the Contract, quantity

adjustments are incorrect, or that the modification for ContractTime is incorrect. For Change Orders that require the Contractor’s assent

(Supplementary Agreements), if the Department processes theChange Order within 15 days of receiving the Contractor’s

signature, the Contractor is barred from protesting the approvedChange Order.

If the Contractor does not protest the order – with a specificreason, it can not be the basis of a claim.

Quantity Increases/Decreases –

Bid prices hold only for increases and decreases thatare within 25% of proposal quantity. Outside that,

prices may be renegotiated.

“Proposal quantity” does not include quantitiesdesignated on the Plans as “if and where directed.”

For minor changes (those ≤ 25%)

payment is made at the bid price.

EXAMPLE #3:Proposal calls for 5,000 CY of DGABC at $10/CY. A COP 

decreases the item by 3,000 LF.

The remaining 2,000 CY is eligible for renegotiation. However,the total cost can not exceed 75% x 5,000 x $10 = $37,500 (or $18.75/CY)

If a major change results in a renegotiated price, the RE willdetermine the locations of which work is to be performed at therenegotiated price and which locations of work is performed atthe bid price.

Subsequent increases in quantities are performed at therenegotiated price. However if subsequent increases exceed25% of the Proposal Qty and 25% of the adjusted qty, theprices may be re-renegotiated.

When the locations of the work to be performed at arenegotiated price are established, subsequent decreases inquantities of work at the bid price will not affect the quantity of work at the renegotiated price.

EXAMPLE #4:The Proposal calls for 800 LF of Beam Guide Rail. A COP increases the quantity 450 LF to 1,250 LF.

200 LF of the increases is paid at the bid price, $ PB1 and 250 LF is paid at a renegotiated price $P R1.

A subsequent COP further increases the quantity 300 LF to 1,550 LF.

200 LF is paid at the renegotiated price $ PR1, , and 100 LF would be eligible for a second renegotiated price $ PR2 Because it exceeds 25% of the Proposal (300 > 25% x 800= 200) and 25% of the quantity at the established price for $ PB1 (300 > 25% x 250).

EXAMPLE #5:The Proposal calls for 800 LF of Beam Guide Rail. A COP increases the quantity 450 LF to 1,250 LF.

200 LF of the increases is paid at the bid price, $ PB1.and 250 LF is paid at a renegotiated price $P R.. The Change Order will note the location(s) for the quantity being paid at $ PR.

If a subsequent COP decreases the item by 300 LF. The quantitydesignated to be paid at $ PR1 is not effected even thought the overall qtyis now less than 125% of the Proposal. It is still paid at the renegotiatedprice. The quantity is only effected if the COP specifically decreases.

Follows federal claims language for Type 1 and Type

2 Differing Site Conditions

Type 1 is when a subsurface or latent conditiondiffers from that specified in the Contract.

Type 2 is when unusable conditions are encounteredthat differ from those ordinarily encountered/inherent in the work.

From the total value of delay damages, when theTotal Adjusted Contract Price cost is greater than theTotal Contract Price, the Department will deduct the

amount of 10 percent applied to the differencebetween the Total Adjusted Contract Price and theTotal Contract Price

If this deduction is greater than the total value of delay damages, the Department is not due a credit

Section 105.01 RE

Assign every correspondence/RFI/Change Notice (claim) sentto the Department a unique correspondence serial number 

The RE will decide questions that arise concerning thefollowing:

1. Quality and acceptability of the work.2. Progress of the Work.

3. Interpretation of the Contract.

4. Modifications to the Contract.

5. The percentage for partial payments made in Estimates,as specified in 109.05.

Section 105.01 RE

The RE has the authority to suspend the Work wholly or in partand to suspend Estimates – for failure of the Contractor to correct conditions unsafe for the

workers or the general public, – for failure to carry out provisions of the Contract, – or for failure to comply with RE direction.

The RE also has the authority to suspend the Work wholly or inpart for  – unsuitable weather,

 – for conditions considered unsuitable for the prosecution of thework, – or for any other condition or reason deemed to be in the interest of 

the public.

Section 105.02 Inspection

Provide safe access for inspection to all parts of theWork. Provide the necessary assistance, includingbut not limited to traffic control, lighting, andscaffolding in order to allow a complete and detailedinspection.

Provisions for un-inspected work

Neither the observations of the RE in the

administration of the Contract, nor inspections, tests,or approvals relieve the Contractor from its obligationto perform the Work in accordance with the Contract.

Table is provided for which drawings are certified and which aresubmitted for approval

Not permitted to change the Contract by submission of aworking drawing

The Department’s certification or approval of working drawingssignifies only that the drawings are in general conformance withthe Contract. It does not relieve the Contractor fromresponsibility for errors and omissions and their correction

Do not deviate from the approved, certified, or conditionallycertified working drawings without obtaining prior writtenapproval from the RE.

Section 105.07 Utilities

Contractor required to send all Utilities within theproject limits an initial notice when beginningconstruction operations.

Contractor required to provide protection of Utilityfacilities as required by Utility

Work by Utilities – the contractor is responsible for 

providing the Utility with advance notice as requiredin Special Provisions and for coordinating the workperformed by the Utilities.

more than 2 hours, the Department has the right to

cancel the request, and require the Contractor tosubmit a new request.

 – Cold Weather Concreting. The RE will prohibit theplacement of concrete when the ambient temperature isbelow 40 °F, unless all surfaces in contact with the concrete

placement are preheated to between 50 and 80 °F andaccess is provided for measuring the temperature of the in-place concrete. For access, establish a 1/2 inch diameter hole that is 6 inches deep at a 45 degree angle by placing a
