The ,proposalhas been appraised by the State Level ExpertAppraisal Committee during itsmeeting held on 16th& 17th September 2008, 19th& 20th December 2008 and19th & 20th March 2009 as per the prescribedprocedur~ in the light ofprovisions under the EIA Notification, 2006 on the basis of the mandatorydocuments enclosedwith the applicationViz., the Application Form-I,and EIAreport and the additional clarifications furnished in response to theobservationsof the State ExpertAppraisal Committee.

    It is noted interalia that the project proposal involves expansion(by process optimization) for enhanced quantity of production inMIs. Asian Paints Ltd, Penta Division located at B5 to B10 of SIPCOTIndustrial Complex, KudikaduVillage, CuddaloreTaluk, Cuddalore District.Noecologically sensitive area exists within 10 km periphery of the project siteThe project does not involve any rehabilitationand resettlement.The proposainvolvesexpansion of the productsas follows:

    The total land area of the project is 29.024 acres of which the greenbelt area is 14 acres. The total cost of the expansion project is RS.1.1croreWater requirement of 695 KLD will be sourced from SIPCOT supply. Thewaste water generated from process (135 KLD) will be treated in the effluentreatment plant. Domestic effluent (35 KLD) will be combined with the tradeffluent and treated in the effluent treatment plant. The treated sewage antrade effluent will be pumped to M/s.CUSECSline for sea disposal. Dynamiwet scrubber for the process emissions and bag filter for the 14 TPH boilehas been provided as APC measures. One number 500 KVA and 600 KVADG sets are installed for emergency purpose. The hazardous wastgenerated (sludge, from ETP-12.4 T/y, spent carbon-200 kg/y) will bcollected, stored and sent to the Common Hazardous Waste ManagemenFacility of TNWML at SIPCOT IndustrialComplex, Gummidipoondi, ChennaThe spent oil - 900 It Iy, waste oil - 300 Itly will be sent to the TNPCB I CPCB

    The project activity is listed at 5 (f) in the Schedule of EIA Notification,2006 and is of B2 Category. Public Hearing/consultationnot required for theproject as it is located in a notified SIPCOT Industrial Complex at KudikaduVillage, Cuddalore District. The Chairman & Managing Director, SIPCOT,Chennai-600 008 in his letter dated 12.6.2009 has informed that themanufacture of Synthetic Organic Chemicals is a permitted activity in theSIPCOT Industrial Complex, Cuddalore and that the common infrastructurefacilities viz Roads, Water Supply, sewer line, STP and Power supply areadequatefor the expansion activity.

    The SEAC after due consideration of the relevant documents,information furnished by you, has recommendedto the SEIAA, Tamil Nadutogrant Environmental Clearance to this project subject to certain conditions.The proposal was considered by SEIAA, Tamil Nadu in its meeting held on16.04.2009 and as the public consultation is not required for the project, theSEIAA hereby accords Environmental Clearance to the above project underthe provisions of EIA Notification dated 14thSeptember, 2006 based on therecommendations of the SEAC subject to the strict complianceof the followingterms and conditions:A. SPECIFIC CONDITIONS - EnvironmentManagementMeasuresi. "Consent for Establishmenf shall be obtained from the Tamil Nadu

    Pollution Control Board and a copy shall be furnished to the SEIAA,Tamil Nadu before taking up of any constructionactivity at the site.Domestic effluent and trade effluent generated from the unit shall betreated in the combined effluent treatment plant consisting ofequalization tank, settling tank, buffer tank, nutrient addition tank,aeration tank, clarifier, settling tank-2 Nos, WTP/cooling tower effluentcollection tank, sludge drying beds, pressure sand filter and activatedcarbon filters and the treated effluent shall satisfy the standards'prescribed by TNPCB. The treated effluent shall be disposed through

    Emergency or accidental Process emissions & the off gas from theprocess vents shall be scrubbed in water and Caustic lye solutionscrubber. The scrubbing liquid shall be sent to ETP for treatment.The project authorities shall strictly comply with the provisions made inManufacture, Storage and Importof HazardousChemicals Rules 1989,as amended in 2000 and the Public Liability InsuranceAct for handlingof hazardous chemicals etc. Necessary approvals from the ChiefController of Explosivesmust be obtainedbefore commissioningof theproject. Requisite On-site and Off-site Disaster Management Planshave to be preparedand implemented.The project authorities shall provide adequatefunds both recurring andnon-recurring to implement the EnvironmentalManagement Measuresstipulated by the SEIAA alongwith the implementationschedule for allthe conditions stipulated herein. The funds so provided should not bediverted for any other purposes.A separate Cell with adequate technically competent staff should beappointed to operate the Environmental Control measures and whichshould report directly to the top Executiveof the plant premises.Regular Ambient Air Quality Monitoring shall be carried out for VOCand HC besides other parameters in ambient air around the Plant. Thelocation and results of existing monitoring stations will be reviewed inconsultationwith the concernedState PollutionControl Board basedonthe occurrence of maximumground level concentrationand downwinddirection of wind. Additional Stations shall be set up, if required. It shallbe ensured that at least one monitoringstation is set up in up-wind& indown-wind direction alongwith those in other directions.. .Occupational health surveillance of workers shall be done on a regularbasis and recordsmaintained as per the FactoriesAct, 1948.Proper House keeping and adequate occupational health programme

    records shall be maintained properly for at least 10 years. Sufficientpreventive measures shall be adopted to avoid direct exposureto emissions and other Hydrocarbonsetc.

    The proponent shall undertake periodical health monitoring of theworkers with special reference to the impact on the respiratory andrenal system and. maintain the document and appropriate monitoring

    . gadgetto be deployedtomonitorVOC.The overall noise levels in and around the plant area shall be kept wellwithin the standards prescribed by the TNPCB by providing noisecontrol measures on all sources of noise generation. The ambientnoise levels shall conform to the standards prescribed underEnvironment (Protection) Rules, 1989 viz. 75 dBA (day time) and 70dBA(nighttime).HCI,HBr,and vapour emissions fromthe reactors/process vents shallbe provided with suitable scrubbers and condensers. Scrubberefficiencyshall be minimum99%.Regular monitoringofVOCand HC in the WorkZone Area in the Plantshall be carried out and data be submitted to SEIAA / TNPCB.Quarterly monitoring of fugitiveemissions shall be carried out as perthe Guidelines ofCPCB.The Company shall harvest surface as well as rainwater from therooftops of the buildings in the project and storm water drains torecharge the ground water and use the same water for the variousactivitiesof the project to conserve fresh water.The Proponent shall furnish an undertaking that they willabide by theconditions/recommendations mentioned in the.EIAIRAreport furnishedby them.Greenbelt shall be developed to mitigatethe effect offugitiveemissionsall around the plant in a minimum30% plant area in consultation withthe DistrictForest Officer(DFO)as per CPCBguidelines.Hazardous Solid waste from process (ETP sludge & spent carbon)shall be sent to the Common SIPCOT Industrial Complex, TSDF, .

Handling and disposal of Hazardous waste shouldcomply with TNPCB norms.Stringent odour control measures should be implemented to preventtotally odour nuisance totally to the neighbourhood population andindustrial units in a completean~ adequatemanner.It is mandatory for the project proponent to furnish to the SEIAA, Halfyearly compliance report in hard and soft copies on 1stJune and 1stDecember of each calendar year in respect of the conditions stipulatedin the prior Environmentalclearance.The unit has to continue to monitor their new product with appropriategadgets.

    B. GENERAL CONDITIONS:i) The Environmental Clearance does not absolve the

    applicant/proponent of his obligation/requirement to obtain otherstatutory and administrativeclearance from the concerned statutoryand administrative authorities."Consent for Establishmenf shall be obtained from the Tamil NaduPollution Control Boardand a copy shall be furnished to the SEIAA,Tamil Nadu before taking up of any constructionactivity at the site.No further expansion or modifications in the plant shall be carriedout without prior approval of the SEIAA. In case of deviations oralterations in the project proposal from those submitted forclearance, a fresh reference shall be made to the SEIAAto assessthe adequacy of conditions" imposed and to add additionalenvironmental"protectionmeasuresrequired, if any.Occupational health surveillanceof the workers shall be carried outon a regular basis and records shall be maintained as per theFactoriesAct, 1948.Usage of Personal ProtectiveEquipments(PPEs) by all employees!workers shall beensured.The project proponent shall also comply with all the environmentalprotectionmeasures and safeguardsproposed in the EMP report.

    The project proponent shall advertise in at least two localnewspapers widely circulated in the region, one ofwhich shall be inthe vernacular language informingthe public that

    i) The project has been accorded EnvironmentalClearance.ii) Copies of Clearance letters are availablewith the Tamil NaduPollution Control Board.

    EnvironmentalClearancemayalso beseen on the website ofthe SEIAA.

    The advertisement should be issued within 7 days from the date ofissue of the clearance letter and a copy of the same shall beforwarded to the SEIAA. The SEIAA may revoke or suspend theclearance, if implementation of any of the above conditions is notsatisfactory.The SElAA reserves the right to stipulate additional conditions, iffound necessary. The company in a time bound manner willimplement these conditions.The above conditions will be enforced, inter-alia under theprovisi(;ms of the Water (Prevention & Control of Pollution) Act,1974, Air (Prevention & Control of Pollution) Act, 1981, theEnvironment (Protection)' Act, 1986, Hazardous Wastes

    . (Management, Handling and Transboundary Movement) Rules,2008 and the Public Liability Insurance Act, 1991 along with theiraplendments and rules.The project proponent shall also submit six monthly reports on thestatus of compliance of the stipulated EC conditions includingresults of monitored data (both in hard copies as well as bye-mail)to the Regional Office of MoEF, Beng~luru, the Zonal Office of-cpce, Bengaluru and the TNPCB. This shall also be put on thewebsite of the Company by the proponent.

    xii)along withthe status of compliance of EC conditions and shall alsobe sent to the RegionalOfficeofMoEF,Bengaluru bye-mail.The proponent shall upload the status of compliance of thestipulated EC conditions, includingresults of monitoreddata on theirwebsite and shall update the same periodically. It shallsimultaneously be sent to the RegionalOfficeof MoEF, Bengaluru,the Zonal Officeof CPCB, Bengaluru and the TNPCB. The criteriapollutant levels namely; SPM, RSPM, S02, NOx(ambient levels aswellas stack emissions) or criticalsectoral parameters, indicatedforthe project shall be monitored and displayed at a convenientlocationnear the maingate ofthe company inthe publicdomain.A copy of the clearance letter shall be sent by the proponent to theCommissioner, Cuddalore Panchayat Union and the Local NGO, ifany, fromwhom suggestions Irepresentations, ifany, were receivedwhile processing the proposal.The clearance letter shall also be put
