This Petition for Redress in the nature of a QUO WARRANTO is a Common-Law

Constitutional Entity and operates in accordance with the following:

On December 6th, 1865, the Supreme Court of the United States of America conceded theratification of the 13th Original Article in the Amendment to the TJnited States Constitution.

Proposed in the year 1810, (2 U.S. Statutes at Large 613), it was recently discovered to have beenproperly ratified under the United States Constitution, Article V. The necessary number to achieveratification was obtained when Virginia ratified the Article and promulgates its ratification in the Laws of

many States as part of the Constitution.

The issue has been brought before the Supreme Court, and the Court conceded the ratification ina 6-3 vote. It was in effect from the day of its ratification on March 12th, 1819, not from the time when

the Supreme Court recognized it.

Therulingwaspromulgatedin(citeomitted). The 13th Original Article inAmendmenttotheUnited States Constitution reads as follows and declares without equivocation:

"If any citizen of the United States shall accept, claim, receive, or retain any title of nobility, orhonor, or without the consent of congress, accept and retain any present, pension, office, or eniolument ofany kind whatsoever, from any Emperor, King, Prince, or Foreign Power, such person shall cease to be acitizen of the United States, and shall be incapable of holding any office of trust or profit under them or

either.of them."

An "Honor" is an advantage or special privilege...A license granted to some, but not generallypossessed by others, giving some unequal opportunity to achieve or exercise political power.

This "Honor" is void through the "Supremacy Clause", Maryland v. Louisiana, 451 U.S. 725, 746(1981), 101 S.Ct. 2114, 2129, 2129, U.S. Supreme Court, "All Laws which are repugnant to theconstitution are null. and void", Marybury v. Madson, 5 U.S. 137, (1803).

T'heir. citizenship is void; they are foreign powers whose lawful status in Ohio Republic is that ofaliens, (Title 8 U.S.C. § 1101 (a)). They possess no immunities for any purpose, nor protection from anysource, and any alleged Judgment(s) or Order(s) from these foreign powers have no standing in Law, theyare void from the beginning and confer no power to enforce.

Only Ohio State BAR members have the PRIVILEGE to "PRACTICE LAW."

Comes now Anthony Lewis of the Jerdine family making a special visitation by absolute

ministerial right to the district court, "restricted appearance" under Rule E(8). William D. Mason has

been making false claims and this counterclaim and notice lis pendens are now in the "original exclusive

cognizance" of the United States through the district court - see the First Judiciary Act of September 24,

1789, Chapter 20, page 77.

Jurisdiction: In international law and according to the law of the land, agents of a foreign

principal are required to file any pretended claim in the appropriate district court prior to exercising

rights to that claim. The district courts have "exclusive original cognizance" of all inland seizures and

this includes vessels in rem (Rule C(3)) such as trust organizations and legal names (William D. Mason,

Henry M. Paulson, Jr., etc)

"...the United States, ... within their respective districts, as well as upon the high seas; (a) saving to suitors, in

all cases, the right of a common law remedy, where the common law is competent to give it; and shall also

have exclusive original cognizance of all seizures on land,..." The First Judiciary Act; September 24, 1789;

This fact of protocol - filing a claim in district court according to international law - is beyond dispute

and extends into antiquity: "Meanwhile those who seized wreck ashore without a grant from the Crown

did so at their peril." Select Pleas in the Court ofAdmiralry, Volume II, A.D. 1547-1602; Introduction -

Proliibitions, Note as to the early Law of Wreck, Selden Society, p. xl, 1897. Even the IRS recognizes

the protocol:

William D. Mason, acting as: "Prosecuting Attorney - Esquire" city of Washington, District of

Columbia, is an agents of a foreign principal, a "foreign state" defined at Title 28 of the United States

Codes § 1603, and Title 22 U.S.C. §611 the Division of Enforcement for the Department of Revenue

(for example C.R.S. §24-1-117 [Colorado]) under principal State Governor in convention with METRO

organization a.k.a. Public Administrative Services Headquarters (PASHQ - signed for example by

Edwin C. Johnson by John T. Bartlett; The Public Papers and Addresses ofTranklin D. Roosevelt, The

Year of Crisis 1933 Random House p. 21.) The Department of Revenue of course being the execution of

bankruptcy proceedings against the citizens of the United States since 1933 currently formed

"hiternational Monetary Fund" and "World Bank" etc. - the State, City METRO municipal and police

powers under United Nations charter law - protected by the same alleged positive law jural society

(international treaty) exemptions home rule (of for example, Article VI and Article XX of the State of

Colorado Constitution, "Transfer of government.")

The district court for the Northern District of Ohio - Cleveland Division has acquired exclusive

original cognizance of this counterclaim for the State of Ohio because this is a federal question - a

Constitutional matter involving a man on the land complaining about kidnap, incarceration and tlreft -

Title 18 U.S.C. §§ 661 and 1201 respectively, and irregular extradition from the asylum state into the

United States custody, treason - Constitution, Article III §3 and Title 18 U.S.C. §2381 by agents of a

foreign principal, creating diversity of citizenship - Title 28 U.S.C. §§1331 and 1333 respectively. T'he

court presentment (notification) is arbitrary and capricious clearly implying that Anthony Lewis, a man,

failed to comply with the alleged terms of a contractual agreement that he is not a party to, and as a

result, is being threatened with "law enforcement" actions by way of incarceration and inland seizure of

his private property. Speaking historically, the districts, formed in 1790 for handling the financial

obligations of the United States could not come into existence until after formal expression of remedy in

the'saving to suitors' clause (1789) quoted above and codified at Title 28 U.S.C. § 1333. The law is

paraphrased in the Internal Revenue Codes:

"Form. The form and content of the notice referred to in subsection (a) shall be prescribed by the Secretary.Such notice shall be valid notwithstanding any other provision of law regarding the form or content of anotice of lien." Title 26 U.S.C. §6323(F)(3). emphasis added

The only excuse for the discretionary authority granted administrative agencies is the judicial oversight

demonstrated in this invocation of an Article III court.

Cause Of Action

Anthony Lewis sojourning on Ohio state land, wlio's Corpus was seized, detained and held

for ransom by the UNITED STATES MARSHAL SERVICE, without venue and exclusive jurisdiction. of

the UNITED STATES, under color of law and office, on the 19'h day of December, A.D. 2007. The arresting

OFFICERS of the UNITED STATES MARSI-IAL SERVICE seized Anthony Lewis without identifying

themselves, and stating the nature and cause of the seizure. The arresting OFFICER(s) of the UNITED

STATES MARSIIAL, SERVICE neglected, or refused to take Anthony Lewis directly before a Judge or

Magistrate for determination of the lawfulness of said search warrant. ALL PERSONS involved

neglected to take Anthony Lewis directly before a Judge or Magistrate for the detennination of the

lawfulness of said searcli warrant. ALL PERSONS involved in the imprisonment of Anthony Lewis

neglected to properly issue any of the Miranda Wamings to him and the other inhabitants residing at said

property. No valid affidavit of probable cause was issued for the arrest and seizure of Anthony Lewis, nor

the visitors of said property. No verified complaint has been filed against Anthony Lewis by any injured

parties. No verified complaint has been filed by a holder-in-due-course of any contract requiring specific

perfonnance, bearing Anthony Lewis' name and Bona Fide signature. No verified complaint has been filed

by a holder-in-due-course of any contract requirimg specific perfonnance, bearing Anthony Lewis' name and

Bona Fide signature. The arresting officer(s) of the UNITED STATES MARSHAL SERVICE, by anned

force, removed Anthony Lewis and his visitors from the venue of Common Law, extradited them to the

UNITED STATES DISTRICT COURT VENUE, without an extradition warrant stating the nature and

cause of the extradition. Anthony Lewis and visitors were concealed at the COUNTY JAIL, warehoused

under the fictitious name ASSAULTED and issued warehouse tracking number(s). NO GRAND JURY

has been convened to investigate the validity of any alleged complaint, in any court, regarding Anthony

Lewis. No presentment or indictment by a Grand Jury has been presented or filed in any court, neither

FEDERAL, STATE, COUNTY or CITY, regarding Anthony Lewis. No LAWFUL summons or arrest

warrant was issued for the arrest and seizure of Anthony Lewis' Corpus. No LAWFUL search and seizure

warrant was issued for Anthony Lewis' personal property. Anthony Lewis of the Jerdine family, as an

inhabitant on Ohio state land, was never served any of the legally required process, nor did Anthony Lewis

at any time waive any immunity of the private /Corporate process of the corporation "CUYAHOGA

COUNTY COMMON PLEAS COURT" as provided at Pub. L. 94-583. Anthony Lewis was not served

in the proper style of process, on the charging (information), that style being, in the name and by authority

of "The State of Ohio". AnthonyLewishas not been charged with a crime, whereas STATE OF OHIO

"Charged" the ENS LEGIS Debtor: ANTHONY LEWIS JERDINE. None of the persons involved ever

established jurisdiction over the man Anthony Lewis on the record, neither CITY, COUNTY, STATE or

FEDERAL. Anthony Lewis has never surrendered, or waived ANY rights as:one of the People, in any court,

nor in any manner. STATE OF OHIO et al, must produce a contract bearing Anthony Lewis' name and bona

fide signature, with any injured parties name(s) and signature(s) affixed where Anthony Lewis.gave them

permission and license in commerce for seizure, arrest, and imprisonment of his body under color of law

whereas, Anthony Lewis has been without the jurisdiction of the DISTRICT OF COLUMBIA andJor

STATE OF OI-IIO. Anthony Lewis of the Jerdiiie family is an Inhabitant on Ohio state land, a

beneficiary of original jurisdiction for The united States of America, A.D. 1789 as amended A.D. 1791.

The "Inhabitant" has never waived any imprescriptable or unalienable Rights to Life, Liberty and/or

Property, as Secured, Guaranteed and Protected by the Constitution for "The State of Ohio" and the

Constitution for The united States of America, and, ultimately, God Almighty. The named defendant in

William D. Mason's original action appears to be the ENS LEGIS Debtor in the UCC-1 Registered:at the ..

State of Georgia, Department of Licensing UCC Division File #.10852005516, and State the of Kentucky

UCC File# 2007-2271963-59.01, and #2007-2284268-01.01. The ENS LEGIS Debtor, a transmitting utility,

including all its property has been accepted for value, and is exempt from levy. The secured party has no

knowledge of a superior claim by any person over the named defendant in William D. Mason's original

action. All known charges against the named defendant in William D. Mason's original action have been

accepted for value.

William D. Mason filed a criminal complaint in the CUYAHOGA COUNTY COMMON _

PLEAS COURT, alleging four (4) violations of an OHIO REVISED CODE agreement against Anthony

Lewis, a man. This presumption is erroneous and is based upon the assumption that Anthony Lewis, a

man, is a U.S. Person, and therefore, a party mandated to en.ter into and obey an OHIO REVISED. .

CODE agreement. William D. Mason's original action does not set forth a cointroversy. William D.

Mason's original action does not contain any evidence establishing Anthony Lewis as having a signature

on any instruments upon which Anthony Lewis has any legal or equitable duty with respect to William

D. Mason or an OHIO REVISED CODE agreement. William D. Mason's original action doos not

contain any direct evidence admissible under the OHIO RULES OF EVIDENCE by the STATE OF .

OHIO, by affidavit, under penalty of perrjury, sworn to be true, correct, and not misleading, establishing

Anthony Lewis as having bona-fide signatures on any instruments which would make Anthony Lewis

liable to William D. Mason or an OHIO REVISED CODE agreement for any specific performance as

set forth in his original action. William D. Mason's original action does not establish whether Anthony

Lewis' prejudice is civil/equity or criminal/equity. Neither does it establish whether or not Anthony

Lewis' prejudice is infamous. Additionally, William D. Mason's original action against Anthony Lewis

does not reveal whether it was initiated by indictment or presentment of the Grand Jury. Moreover,

William D. Mason's original action does not reveal the constitutional authority upon which he is

proceeding to deny Aiithony Lewis, a man, the protected right of not being held to answer an infatnous

crime without an indictment or presentment by the Grand Jury. The law averred in William D. Mason's

original action against Anthony Lewis is located in the OHIO REVISED CODE, which the OHIO

STATE LEGISLATURE intended to be applied in liniited fashion upon a class specifically called

"Persons." William D. Mason's.original action against Anthony Lewis, does not cite the specific OHIO

REVISED CODE in which the OHIO STATE LEGISLATURE included natural born men and women

whom are inhabitants on Ohio state land in the specific LEGISLATIVE STATUTORY definitions of the

class known as "Persons." Furthermore, William D. Mason's original action does not reveal the identity

of the alleged damaged party, nor does it reveal the substance which the alleged damaged party had at

risk. Consequently,. Williani. D. Mason's original action does not disclose his right of action or cause of

action. Therefore, Anthony Lewis is entitled to be discharged from William D. Mason's original action

due to his failure to state a claim for which relief can be granted (Rule 12 (b)(6)). Regarding the

payment of alleged fines require.d by the presumed OHIO REVISED CODE agreement, it should also be

noted, that Anthony Lewis is nof a willing endorser of the private credit system of the Federal Reserve,

which was never offered in good faith. STATE OF OMO violated Art.1, Section 10, of the Constitution

for The united States of America as amended A.D. 1791. Legal tender (Federal Reserve) Notes are not good

and lawful money of the United States pursuant to Rains v. State, 226 S.W. 189 Pursuant to IRS Code

Section 1.1001-1 (4657)C.C.H.:Federal Reserve Notes are valueless. The subjection to Special Drawing

Rights (Paper Gold) is one thing but presuming endorsement of fractional lending practiced outside the.

scope of lawfut,money is unlawful an.d such presumption is defeated by law herein, nunc pro tunc. See

Title 12 U.S.C. § 411; Anthony Lewis is and always would have exercised his right to handle lawful

money had the option ever been presented in good faith. The "secret" indictment utilized for the claim

was irregular pursuant to "do process of law," as a result, Anthony Lewis wishes to invoke judicial

review, "and any other provision of law" to nullify any supposed justification for any further such

incarceration/detention/theft action - manifest in actual or threatened

kidnap/incarceration/detention/theft. The "secret" indictment upon which the kidnap, incarceration and

theft are based, has been Refused for Cause timely (considering preparation of proper remedy) and the

red ink original Reftisal. for Cause has been returned to William D. Mason, in his copy of the.

counterclaim and summons. All other copies and the original counterclaim filed with the court have

black ink (copy) Refusals for Cause on the face of the "secret" indictment of November 6, 2007.

Verified Statement Of Right

Anthony Lewis owns all items in his name and any legal artifice he has chosen to do business as, having

established a prior perfected maritime lien evidenced by National UCC Filing # 2007-2284268-01.01.

Stipulation Of Acceptable Answer

The issue is simple: Agents of a foreign principal are required to file their complaint in the

appropriate district court prior to exercising any claim against a man on the land. This is international

and connnon law; which includes but is not limited to, any and all agents acting for the Bankruptcy of

the United States, through any of its District of Columbia Corporations or Political Subdivisions.

William D. Mason must directly address the validity of the (telephone) certificate of search that clearly

shows there have been no claims filed against"Anthony Lewis" or any pseudonym through which

Anthony Lewis may be engaged in contract. The court clerk James R. Manspeaker (District of Colorado,

now replaced by Gregory Latigham) obfuscated remedy by denying proper certificates, so William D.

Mason and anyone else for that matter can easily research case history against Anthony Lewis or any

legal name. William D. Mason may call (216). 357-7000 to conduct searches and of course the Article III

judge can research cases in chambers. Itis however reasonable to say that if the William D. Mason is

moving on a valid claim and judgment in the district court then the William D. Mason knows what case

that is.

The United States is not a party in interest to this action. Any registered attomey responding for William

D. Mason cannot be a citizen of the United States due to the de jure Thirteenth Amendment of the

Consti.tution. A certified copy is attached and fully incorporated i.nto this counterclaim. (The federal.

judge assigned this case is competent to adjudicate under Article III due to "inactive" status with the

State Supreme Court attorney register.) Addressing the certificate of search is the only response that will

be considered an answer to this counterclaim. Failure to answer will be met with Default Judgment for

Anthony Lewis according to the notice oh the face of the Summons.

Stipulation of remedy

The recourse sought is immediate exclusive original cognizance of the United States through the

district court. This case is repository for evidence for injunctive relief from any future presentments,

kidnap, incarceration, or theft actions from any foreign agents or principals. Anthony Lewis' mother:

well. Though the kidnap/incarceration/theft could be justified by notice and sophistry under the color of

law of municipal structure, the proceedings have obviously been under the pretended authority of

unconscionable contracts and the recourse requested is proper. There is no excuse for the arbitrary and

capricious attoniey actions - debt action in assumpsit - that have confronted good men and women

since the Banker's Holiday. Roosevelt implemented a "voluntary compliance" national debt (upon the

States by Governor's Convention) but utilized the 1917 Trading with the Enemy Act to compel citizens

of the United States to comply. The substitution of citizen of the Uaited States for the German nationals

on this land was against Stoehr v. Wallace, 255 U.S. 239 (1921) where the Court clearly expresses "The

Trading with the Enemy Act, originally and as amended, is strictly a war trieasure..." - directly citing the

Constitution Article I, § 8, clause 11. The war on the Great.Depression 1) does not count and 2) would

The privilege against self-incrimination is neither accorded to the passive resistant, nor the personwho is ignorant of his rights, nor to one indifferent thereto. It is a fighting clause. Its benefits can be retainedonly by snstained combat. It cannot be claimed by attorney or solicitor. It is valid only wheii insisted uponby a belligerent claimant in person. The highlighted bold sentence in the above quote adnionishes against any clerk action that falsely brands

Anthony Lewis Pro Se - to imply that Anthony Lewis is representing himself before the district cotui.

attorney) "judge" is assigned this case or the Article III judge chooses to protect the fiduciary interests of

Anthony Lewis is a man with God-given unalienable rights, one living and regenerate entity of sound

mind and body. For some realistic perspective the Credit River Money Decision is attached and fully

incorporated into this counterclaim. William D. Mason is clearly the debtor and Anthony Lewis is

clearly creditor.

No Magistrates

No one may handle this case but an Article III Judge. The nature of this cause is injunctive relief,

albeit preemptive. Title 28 U.S.C. §636(b)(1)(A) cannot ensue, "...except a motion for injunctive

relie£.."
